RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize Chair of the Board to execute, the attached Professional Services Agreement (Attachment 2) with the California Forensic Medical Group (CFMG) regarding the provision of medical services to the incarcerated populations in both the HCCF and JH in the amount of $17,002,993.41 for the period of April 1, 2022, to June 30, 2025;
2. Authorize the Sheriff, Correctional Captain, or Deputy Director of Sheriff’s Administration to execute any and all subsequent amendments to the attached professional services agreement with CFMG, after review and approval by County Counsel, Risk Management and the County Administrative Office;
3. Direct the Clerk of the Board to return one fully executed original copy of the attached professional services agreement with CFMG to the HCCF, Captain Duane Christian for further processing;
4. Delegate authority to transfer accounting responsibility of budget 1100-490 from Department 30 - Department of Health & Human Services to Department 25 - Sheriff’s Office; and
5. Approve the Supplemental Budget for FY2021-22 for 1100-490 (Attachment 1) (4/5 vote required).

DISCUSSION:
COUNTY, by and through the Humboldt County Sheriff’s Office, Probation Department, Department of Health and Human Services - Public Health (DHHS), and County Administrative Office, desires to retain a qualified professional to provide professional, medical, dental, and similar health care services and related administrative services for COUNTY’s correction and detention facilities; and such work involves the performance of professional, expert and technical services of a temporary and occasional character. COUNTY has no employees available to perform such services and is unable to hire employees for the performance thereof for the temporary period. CFMG represents that it is adequately trained, skilled, experienced, and qualified to perform such services required by COUNTY.
Delegating authority to transfer accounting responsibility of budget 1100-490 from Department 30 - Department of Health & Human Services to Department 25 - Sheriff’s Office will allow the Sheriff’s Office to fully manage the California Forensic Medical Group contract and the Inmate Medical budget unit (1100-490).
Accordingly, the Sheriff recommends that the Board of Supervisors approve, and authorize the Chair of the Board to execute, the attached Professional Services Agreement with CFMG regarding the provision of medical, dental and similar health care services for the period of April 1, 2022, to June 30, 2025. Staff also recommends that the Board authorize the Sheriff, Correctional Captain or Deputy Director of Sheriff’s Administration to execute any and all subsequent amendments to CFMG, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed medical, dental and similar health care services.
FINANCIAL IMPACT:
The attached professional services agreement with CFMG has a total amount payable of $17,002,993.41 for the period of April 1, 2022, to June 30, 2025. However, in the event local, state, or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached Professional Services Agreement with CFMG.
Expenditure appropriations in the amount of $4,099,177 related to the attached agreement was included in the approved FY 2021-22 budget for DHHS Public Health 1100-490 Medical Services. There is an expected increase of $262,283 for the remainder of FY 2021-22 for the attached Professional Services Agreement with the CFMG. Additionally, there is an anticipated increase of $302,490 for Jail Medical Catastrophic Care. Funding to cover the increases is available through increased revenue from the Tobacco Lawsuit Settlement of $87,410, Community Corrections of $250,733, and American Rescue Plan Act of 2021 of $227,930 for FY 2021-22 per the attached supplemental budget (Attachment2). As a result, there is no impact to the General Fund for FY 2021-22. For FY 2022-23 and beyond, additional General Fund dollars will be necessary for the increased costs of the agreement. As a result, approval of the agreement with CFMG will impact the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the agreement or allow the Chair of the Board to sign such agreements, however this is not recommended because it would end our current partnership with CFMG and leave us without a medical provider to administer medical care to the incarcerated population in the HCCF and JH. CFMG was the only bidder in this RFP.
