RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Waive the requirements of the Humboldt County Nuclear Free Ordinance with regard to the attached berthing permit and rental agreement with the Humboldt Bay Harbor, Recreation and Conservation District;
2. Approve and authorize the Chair of the Board to execute the attached berthing permit and rental agreement retroactively to July 1, 2024, through June 30, 2025, in the amount of $4,122, between the Humboldt County Sheriff’s Department and the Humboldt Bay Harbor, Recreation and Conservation District; and
3. Direct the Clerk of the Board to return one (1) fully executed original copy of the attached berthing permit and rental agreement with the Humboldt Bay Harbor, Recreation and Conservation District to the Department of Public Works - Real Property for further processing.

DISCUSSION:
The Humboldt County Sheriff Department’s Boating Unit has kept a boat at the Woodley Island Marina since 2015. The Boating Safety Program is responsible for activities such as enforcement of state and local boating regulations, inspection of vessels, as well as search and rescue operations. The Marina is operated by the Humboldt Bay Harbor, Recreation and Conservation District. The Sheriff’s Department is requesting approval to renew the rental of their slip. The rental sum total for the year is $4,122. As stated in the Humboldt Bay Harbor, Recreation and Conservation District’s Rental Agreement, “payment of advance monthly payments shall remain at all times a month-to-month tenancy.”
A waiver of the Nuclear Free Ordinance is requested as the Humboldt Bay Harbor, Recreation and Conservation District’s berthing permit and rental agreement does not contain the Nuclear Free Ordinance language.
This agreement comes before your Board after the start of the term due to inadvertent delays in receiving and finalizing the berthing permit and rental agreement.
Accordingly, staff recommends that the Board approve, and authorize the Chair of the Board to execute the attached berthing permit and rental agreement with the Humboldt Bay Harbor, Recreation and Conservation District regarding the use of moorage space located at the Woodley Island Marina for the period of July 1, 2024, through June 30, 2025.

Narrative Explanation of Financial Impact:
The attached berthing permit and rental agreement with the Humboldt Bay Harbor, Recreation and Conservation District has a maximum amount payable of $4,122 for the period of July 1, 2024, through June 30, 2025. Funding is available through Boating Safety and Enforcement Financial Aid Program in the Sheriff’s Boating Safety Budget (1100-221900) and is included in the proposed fiscal year 2024-25 budget.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached berthing permit and rental agreement with the Humboldt Bay Harbor, Recreation and Conservation District regarding the use of moorage located at Woodley Island Marina. However, this is not recommended as Woodley Island is an ideal location from which to operate the boat due to its proximity to other boat users, availability of parking for Sheriff’s vehicles, equipment, meetings and communications with the Humboldt Bay Harbor, Recreation and Conservation District staff.
