RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Accept the completed contract, including all change orders approved by the Public Works Department, between GR Wilcox Enterprises, Inc., and Humboldt County for construction of Storm Damage Repair to Telegraph Creek Road (4A150) Post Mile 1.20; and
2. Approve the final claim for payment, to be submitted by the Public Works Department to the Auditor-Controller, in the amount of $690, which will bring the total amount paid to 100% of the contract.

DISCUSSION:
From February 13 to 15, 2019, and from February 24 to March 1, 2019, the Governor of the State of California declared a disaster for Humboldt County due to an atmospheric river event resulting in flooding and mudslides. Telegraph Creek Road (4A150) Post Mile 1.20, located in the community of Shelter Cove in the southwestern corner of Humboldt County, experienced roadway failure due to high flows in Telegraph Creek. The roadway failure also caused a water main that services residents in the Shelter Cove Subdivision to break, which further eroded and closed the roadway. Public Works performed emergency measures, including installing a flatcar bridge to span the damaged area, to reopen the road.
On May 1, 2020, the Humboldt County Department of Public Works (Public Works) received Federal Emergency Management Agency (FEMA) funding approval to proceed with the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project. Public Works prepared plans and specifications for the project based on a topographic survey of the damaged area prepared by Points West Surveying Company. The work consisted of removing and replacing the damaged culvert and concrete headwalls, reconstructing the roadway to original width, and installing overside drains and erosion and sediment control items.
On May 16, 2023, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project for bids. On June 13, 2023, the County of Humboldt received three bids for the project. On July 11, 2023, the Humboldt County Board of Supervisors awarded the project agreement to GR Wilcox Enterprises, Inc., the lowest responsive bidder. The award amount was $706,541.66. Contract change orders executed during the project decreased the authorized amount by $22,729.17.
Public Works recommends that the Board of Supervisors accept the completed contract, including all change orders approved by Public Works for this project, and approve the final claim for payment.

Narrative Explanation of Financial Impact:
Total construction costs for the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project are $683,812.49. Progress payments totaling $683,122.49 have been paid, and the final claim for payment in the amount of $690 is outstanding. The Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project is funded by FEMA Disaster Recovery funds (75%), California Governor’s Office of Emergency Services (18.75%), and the Humboldt County Road Fund (6.25%). Expenditure appropriations relating to completion of the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project are included in the approved fiscal year (FY) 2024-25 Road Fund Budget (1200321-8940).
The amount shown in the Financial Impact Table above ($39,928.21) does not include Progress Payments Number 1 through 7 ($643,884.28) because this work was performed in FY 2023-24.
Projects are paid in arrears with anticipated funding coming from FEMA as mentioned above. The FY 2022-23 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $6 million in the county's Road Fund. Even after allocating nearly $6.8 million of American Rescue Plan Act (ARPA) funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately $9.7 million.
This negative balance is partially due to the timing of FEMA reimbursements to the county, which can take years for the county to receive repayment. The current total of outstanding repayments is approximately $7.5 million. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects. Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

Accepting the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board of Supervisors may choose not to accept the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project. However, this alternative is not recommended because the project has been completed, and the requested Board actions are needed to accept the contract.
