RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve the redistributions of fees collected from $3 for each additional page of recordable documents as follows: deallocate $1 from the Trial Court Trust Fund and allocate $1 to the General Fund,  Clerk/Recorder  (1100271).

DISCUSSION:

In 1997, the Trial Court Trust Fund was established, funded in part by recorder fees as per GC 68085. A 2000 amendment removed Recorder Fee Code (GC 27361) from this arrangement.

 

Currently, for each additional recorded page, $3 is charged and is distributed as follows: $1 to Modernization, $1 to the General Fund, Clerk/Recorder  (1100271) and $1 to the Trial Court Trust Fund.

 

The proposed change will adjust this allocation to $1 to Modernization and  $2 to the General Fund, Clerk/Recorder  (1100271),  maintaining compliance with the Government Code without increasing overall fees.

Narrative Explanation of Financial Impact:

The Clerk/Recorder (1100271), General Fund will retain the reallocated fee, instead of transferring to the Trial Court Funding Realignment.

The Board could deny the request to reallocate funds. However, this is not recommended due to the change in the government code.
