RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Receive and approve the plans and specifications for the Conflict Counsel Americans with Disabilities Act Compliance Project, Project Number 2024-402; and

2.                     Authorize the Clerk of the Board to advertise the above-referenced project, pursuant to Section 22037 of the California Public Contract Code, with bids to be opened on April 30, 2024.

DISCUSSION:

On September 7, 2016, the County of Humboldt entered into a Consent Decree with the United States Department of Justice that required the commencement of the Humboldt County Americans with Disabilities Act (“ADA”) Compliance Project. The purpose of the Humboldt County ADA Compliance Project is to bring all facilities owned or leased by the County of Humboldt that provide programs, services and activities to the public into compliance with the ADA.  Conflict Counsel is currently located in a facility that was listed in the Consent Decree as having barriers to access as defined under the ADA.  The building that Conflict Counsel is located in currently is a Victorian, built in 1900, and is not conducive to barrier remediation.

 

On November 7, 2023, the Humboldt County Board of Supervisors (“Board”) authorized the County of Humboldt to enter into a commercial lease with the owners of 515 J Street, Eureka, California to relocate Conflict Counsel from their current non-ADA accessible location.  Per the lease terms, the County of Humboldt agreed to remediate site arrival point barriers to access prior to program occupancy and has the option to purchase the facility.

 

The Conflict Counsel ADA Compliance Project consists of reconstruction of one van accessible parking stall, relocation of the entrance door, reconfiguration of the retaining wall, development of an accessible path of travel, and removal and replacement of the stairs that serve the second story of the facility located at 515 J Street, Eureka, California.  The project is estimated to cost Eighty Thousand Dollars ($80,000.00) and is anticipated to take ninety (90) calendar days to complete.  The Humboldt County ADA Compliance Team worked with the Humboldt County Department of Public Works and Brokaw Design for the design and timeline for the project delivery.

 

FINANCIAL IMPACT:

In fiscal year 2023-2024, the Board allocated Eighty-Five Thousand Dollars ($85,000.00) from the 2020 Finance Plan to fund the design and construction of the Conflict Counsel ADA Compliance Project.  Funds for this project are in the fiscal year 2023-2024 budget for Conflict Counsel budget unit 1100-246.  Current design costs in the amount of Sixty-Eight Thousand Nine Hundred Eighteen Dollars ($68,918.00) combined with estimated construction cost of Eighty-Thousand Dollars ($80,000.00) establishes an estimated total project cost of One Hundred Forty-Eight Thousand Nine Hundred Eighteen Dollars ($148,918.00).  A supplemental budget may be needed once the project has bid and actual construction costs are known.   

 

STAFFING IMPACT:

Putting the Conflict Counsel ADA Compliance Project out to bid will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to approve the plans and specifications for the Conflict Counsel ADA Compliance Project.  However, this alternative is not recommended as Conflict Counsel was listed as a facility requiring ADA barrier remediation under the Consent Decree and is currently housed in a facility that is not in full compliance with the ADA.
