RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Accept the completion of the Conflict Counsel Americans with Disabilities Act Compliance Project, Project No. 2024-402; and
2. Authorize the Purchasing Agent, or a designee thereof, to execute the attached Notice of Completion for the Conflict Counsel Americans with Disabilities Act Compliance Project; and
3. Direct the Clerk of the Board to provide the County Administrative Office - Americans with Disabilities Act Compliance Team with one (1) fully executed certified copy of the Board order related to this item.

DISCUSSION:
On November 7, 2023, the Humboldt County Board of Supervisors (“Board”) authorized the County of Humboldt to enter into a commercial lease with the owners of 515 J Street, Eureka, California, to relocate Conflict Counsel from their current location, which is a facility that was specifically listed in the 2018 Consent Decree with the Department of Justice for non-compliance with Title II of the Americans with Disabilities Act (“ADA”). Per the lease terms, the County of Humboldt agreed to remediate site arrival point barriers to access prior to program occupancy.
On June 29, 2021, the Board adopted the Humboldt County ADA Compliance Plan which requires all newly acquired leased facilities be in full compliance with Title II of the ADA prior to program occupancy.
On December 8, 2023, the County of Humboldt entered into an agreement with Brokaw Design, Inc. for architectural design and construction oversight services necessary for the Conflict Counsel ADA Compliance Project. The Board subsequently authorized the project to be publicly bid on April 9, 2024.
On April 30, 2024, the County of Humboldt received and opened two (2) responsive and responsible bids with Sequoia Construction Specialties, Inc.’s. bid of One Hundred Sixty-Thousand Eighty-One Dollars ($160,081.00), being the lower of the two (2) bids that were submitted. Sequoia Construction Specialties, Inc.’s base bid combined with design costs, internal project and support costs and project contingencies establishes an updated total estimated project cost of Tow Hundred Ninety Thousand Four Hundred Thirty-Six Dollars ($290,436.00).
On May 21, 2024, the Board awarded the Conflict Counsel ADA Compliance Project to Sequoia Construction Specialties, Inc. At that time, due to the timeline pertaining to adoption of the County of Humboldt’s budget, staff indicated that they would bring a supplemental budget for Conflict Counsel (1100246) for fiscal year 2024-2025 to the Board to increase the fixed asset line for the remaining portion of the project estimate using County Administrative Office approved finance plan funding in the amount Tow Hundred Five Thousand Four Hundred Thirty-Six Dollars ($205,436.00). That supplemental budget was brought to the Board on July 23, 2024.
Subsequent to the award, two (2) change orders were issued for Sequoia Construction Specialties, Inc. The first change order, issued on August 20, 2024, for Four Thousand Eight Hundred Forty-Two Dollars ($4,842.00) for the installation of a new door and frame due to unforeseen foundation anchor points located inside the proposed new door opening location. The second change order, issued on January 14, 2025, for Three Thousand Eight Hundred Thirty-Three Dollars ($3,833.00) and was for the demolition and replacement of the old post bases, which were below grade, as well as the installation of a new mail chute. These change orders, totaling Eight Thousand Six Hundred Seventy-Five Dollars ($8,675.00), account for unforeseen adjustments in the scope of work during the project.
Sequoia Construction Specialties, Inc. has substantially completed their contractual obligations, and therefore, the Humboldt Conflict Counsel ADA Compliance Project can be accepted as complete in accordance with the contract documents. The Board must accept the project prior to filing final acceptance. After the Board’s acceptance, the required Notice of Completion can be filed with the Humboldt County Recorder and the mandatory thirty-five (35) day lien period can begin. Following completion of the lien period, the County of Humboldt can release or reduce the payment retention, provided that no stop notices have been filed and any remaining contract work has been completed.

The total cost for the Conflict Counsel ADA Compliance Project is anticipated to be Two Hundred Sixty Thousand One Hundred Dollars ($260,100.00). Seventy-One Thousand Six Hundred Fifty-One Dollars ($71,651.00) was spent on the project in fiscal year 2023-2024. It is estimated that One Hundred Eighty-Eight Thousand Four Hundred Forty-Nine Dollars will be spent on the project in fiscal year 2024-2025, including to date expenditures. The total contract cost with Sequoia Construction Specialties, Inc. is One Hundred Sixty-Nine Thousand Five Hundred Fifty-Five Dollars ($169,555.00). In fiscal year 2024-2025, there are sufficient appropriation for remaining costs of design, construction and inspections in Conflict Counsel budget unit 1100-246. The Conflict Counsel ADA Compliance Project was funded through the 2020 Finance Plan.
STAFFING IMPACT:
The recommended actions will not impact current staffing levels.
OTHER AGENCY INVOLVEMENT:
None
ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to accept the Courthouse Fourth Street ADA Modification Project. However, this alternative is not recommended as Sequoia Construction Specialties, Inc. has completed its contractual obligations and therefore is entitled to release of retention at the conclusion of the thirty-five (35) day lien period.
