RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Waive the requirements of the Humboldt County Nuclear-Free Ordinance with regard to the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority;
2. Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute, the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities for the period of July 1, 2021 through June 30, 2022;
3. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments, and any other agreements, certifications, attestations and documents directly related, to the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority, after review and approval by County Counsel, Risk Management and the County Administrative Office.

DISCUSSION:
Pursuant to California Welfare and Institutions Code Sections 4330, et seq., the California Mental Health Services Authority contracts with the California Department of State Hospitals regarding the use of state hospital facilities on behalf of counties participating in the State Hospitals Program. The attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority will allow the Humboldt County Department of Health and Human Services - Behavioral Health (DHHS - Behavioral Health) to place Humboldt County clients who require 24-hour supervision at any of the five state hospitals, when no other facilities are available, for the period of July 1, 2021 through June 30, 2022. It should be noted that the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract development process.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached memorandum of understanding with the California Department of State of Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities for the period of July 1, 2021 through June 30, 2022. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to approve any and all subsequent amendments, and any other agreements, certifications, attestations and documents directly related, to the attached memorandum of understanding with the California Department of State of Hospitals and the California Mental Health Services Authority, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the placement of Humboldt County clients at state hospital facilities.
The waiver from the provisions of the Nuclear Free Ordinance is requested because the State of
California will not modify its agreements to accommodate local ordinances.
FINANCIAL IMPACT:
Pursuant to the terms and conditions of the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority, the County of Humboldt will reimburse the California Department of State Hospitals at the daily rate of $626 per client placed at acute and intermediate care facilities and $775 per client placed at skilled nursing facilities for the period of July 1, 2021 through June 30, 2022. Expenditure appropriations related to the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority have been included in the approved fiscal year 2021-2022 budget for DHHS - Behavioral Health Administration budget unit 1170-424. Funding for the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority is available through realignment revenues allocated to DHHS - Behavioral Health. As a result, approval of the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority will not impact the Humboldt County General Fund.

The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, creating opportunities for improved safety and health and providing community-appropriate levels of services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities. However, this alternative is not recommended since it would prevent DHHS - Behavioral Health from placing Humboldt County clients who require twenty-four (24) hour supervision at state hospital facilities when no other facilities are available.
