RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve Cooperative Agreement No. 24-0469-005-SF, Pierce's Disease Control Program contract in the amount of $13,220.19 between Humboldt County and the California Department of Food and Agriculture (CDFA) for the period beginning July 1, 2025, and ending Sept. 30, 2026; and
2. Authorize the Chair to sign the original agreement and direct the Clerk of the Board to return all copies to the Agricultural Commissioner's office for further processing; and
3. Grant a waiver from the provisions of the Nuclear-Free Ordinance.

DISCUSSION:
Pierce's Disease Control Program (PDCP) contract funds trapping and survey activities that are intended to protect Humboldt County's viticulture industry from a serious disease known as Pierce's Disease. Pierce's Disease is caused by the bacterium Xylella fastidiosa and is spread by the Glassy-Winged Sharpshooter (GWSS). In addition to grapes, GWSS infests many species of
ornamental plants and nursery stock. To prevent the spread of Pierce's Disease to Humboldt County, the PDCP division of CDFA monitors nursery stock and other plant product shipments into the county from areas under quarantine for GWSS. Agriculture Department staff place and inspect GWSS yellow panel traps at nurseries receiving shipments. Traps are also placed in residential areas where host species of ornamental plants are present.

The waiver from the provisions of the Nuclear Free Ordinance is requested because the State of California will not modify state cooperative agreements to accommodate local ordinances. The Agricultural Commissioner's office receives annual funding from CDFA to offset local costs associated with implementing mandated state programs at the County level. This agreement comes before your Board after the start date due to delays in the contract process with the state.

Narrative Explanation of Financial Impact:
All costs for the Pierce's Disease Control Program for personnel, mileage and supplies will be reimbursed by the state. This agreement will allow for reimbursement in the total amount of $13,220.19. Costs are billed to CDFA monthly and payment is made in arrears to Humboldt County. The department's budget appropriations were included in the FY 2025-26 budget in Fund 1100, Budget Unit 261 -Agricultural Commissioner in anticipation of this agreement therefore no supplemental budget accompanies this request. Funds anticipated for FY 2026-27 will be included in the annual budget development cycle.

STAFFING IMPACT:
There currently is no impact on staffing.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the agreement. However, this is not recommended as the revenue is used to reimburse county costs for the Pierce's Disease Control Program.
