RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Ratify Ordinance 19-19 of the Arcata Fire Protection District which adopts the 2019 California Fire Code Title 24, Part 9 which consists of the 2018 International Fire Code as amended with errata;

2.                     Direct the Clerk of the Board to transmit the Board’s determination to the Arcata Fire Protection District within 15 days of such determination; and

3.                     Direct the Clerk of the Board to file a copy of the findings of the Arcata Fire Protection District, and any findings of the county, along with a copy of the adopted ordinance, with the California Department of Housing and Community Development.

DISCUSSION:

The Arcata Fire Protection District adopted the 2019 California Fire Code by reference with the adoption of Ordinance 19-19.  Ordinance 19-19 had its first reading on Oct. 8, 2019, and was adopted at the district’s regular meeting of the Board of Directors on Nov. 12, 2019.

 

Any fire protection district that proposes to adopt an ordinance pursuant to California Health and Safety Code 13869.7 shall, not less than 30 days prior to noticing a proposed ordinance for public hearing, provide a copy of that ordinance, together with the adopted findings to the county where the ordinance will apply.

 

A copy of Ordinance 19-19 was received by the Humboldt County Administrative Office on Dec. 19, 2019 via U.S. mail.  Arcata Fire Protection District reports no comments were received on Ordinance 19-19.

 

The district has completed their internal process of adopting the 2019 California Fire Code by reference with adopting Ordinance 19-19.  As a special district, the district is mandated to seek approval pursuant to Health and Safety Code 13869.7 (c) of this adoption from the county Board of Supervisors.  The code reads: “The fire protection district shall transmit the adopted ordinance to the city, county, or city and county where the ordinance will apply.  The legislative body of the city, county, or city and county, may ratify, modify, or deny an adopted ordinance and transmit its determination to the district within 15 days of the determination.” 

 

The 2019 California Fire Code prescribes regulations governing conditions that are hazardous to life and property from fire or explosion. The 2019 California Fire Code, which consists of the 2018 International Fire Code as adopted and amended, shall be enforced by the Fire Prevention Bureau of Arcata Fire Protection District, and shall be operated under the supervision of the Chief of the District. 

 

The district is requesting that the Board of Supervisors ratify the adopted Ordinance 19-19.

 

Health and Safety Code 13869.7 (c) also provides that “Upon ratification of an adopted ordinance, the city, county, or city and county, shall file a copy of the findings of the district, and any findings of the city, county, or city and county, together with the adopted ordinance expressly marked and identified to which each finding refers, with the Department of Housing and Community Development.”
