RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Adopt the attached resolution which authorizes the Department of Health and Human Services Director, or a designee thereof, to execute and deliver Program Funding Agreement Number 7480-CACCE-CP_2057_HUMBOLDT-01-G with HORNE as successor for Advocates for Human Potential, Inc. as the third-Party Administrator for the Community Care Expansion Preservation Program, along with any and all other agreements, certifications, attestations and documents, including, without limitation, any and all agreements with other entities, and any and all amendments thereto, that are required or deemed necessary or appropriate to evidence and secure funding made available by the California Department of Social Services through the Community Care Expansion Preservation Program and the County of Humboldt’s obligations related thereto;

2.                     Approve the attached supplemental budget request in the amount of Four Hundred Fifty Thousand Six Hundred Seven Dollars ($450,607.00) for Department of Health and Human Services - Social Services budget unit 1160-511 (4/5 Vote Required); and

3.                     Direct the Clerk of the Board to return one (1) fully executed certified copy of the attached resolution to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:

California has a shortage of adult and senior care facilities, including, without limitation, Adult Residential Facilities and Residential Care Facilities for the Elderly, that accept individuals receiving or applying for Supplemental Security Income, State Supplemental Payment or the Cash Assistance Program for Immigrants.  The state has also seen a decline in the number of Supplemental Security Income and State Supplemental Payment recipients residing in adult and senior care facilities.

 

The Community Care Expansion Preservation Program (“CCE Preservation Program”) was established by California Assembly Bill 172 to fund capital projects and promote the sustainability of residential adult and senior care facilities in California and to address historic gaps in the long-term care continuum.  The California Department of Social Services will provide a total of Eight Hundred Five Million Dollars ($805,000,000.00) in funding through the CCE Preservation Program for acquisition, construction and rehabilitation to preserve and expand adult and senior care facilities that serve Supplemental Security Income, State Supplemental Payment and Cash Assistance Program for Immigrants applicants and recipients, including, without limitation, individuals who are experiencing, or at risk of experiencing, homelessness.

 

The Humboldt County Department of Health and Human Services (“DHHS”) has been awarded Two Hundred Forty-Six Thousand Three Hundred Twenty-Six Dollars ($246,326.00) through the Operating Subsidy Payment component of the CCE Preservation Program to cover operation deficits, including, without limitation, those related to staffing and payroll, utilities, insurance and building maintenance, for the period of August 22, 2023 through June 30, 2029.  DHHS has also been awarded Two Hundred Four Thousand Two Hundred Eighty-One Dollars ($204,281.00) through the Capital Project component of the CCE Preservation Program to cover certain capital projects that are designed to make critical repairs and/or required updates to preserve, and prevent closure of, adult and senior care facilities in Humboldt County for the period of August 22, 2023,  through December 31, 2026.  While the CCE Preservation Program funding received by DHHS will be available through the above-referenced dates, DHHS is currently working with Aguilar Manor, the only qualifying facility in Humboldt County, to identify and complete necessary repairs/upgrades, and it is anticipated such CCE Preservation funding will be expended in fiscal year 2023-2024. 

 

DHHS has been notified by the California Department of Social Services that Advocates for Human Potential has been replaced with HORNE as the third-party Program Funding Agreement Manager. The California Department of Social Services has not provided a new Program Funding Agreement and has stated that after the original Agreement is executed a new Agreement will be provided by HORNE if necessary.

 

Accordingly, DHHS recommends that the Board adopt the attached resolution which authorizes the DHHS Director, or a designee thereof, to execute and deliver Program Funding Agreement Number 7480-CACCE-CP_2057_HUMBOLDT-01-G with HORNE as successor for Advocates for Human Potential, Inc., the third-Party Administrator for the CCE Preservation Program, along with any and all other agreements, certifications, attestations and documents, including, without limitation, any and all agreements with other entities, and any and all amendments thereto, that are required or deemed necessary or appropriate to evidence and secure funding made available by the California Department of Social Services through the CCE Preservation Program and the County of Humboldt’s obligations related thereto.

Acceptance of the CCE Preservation Program funding made available by the California Department of Social Services will allow DHHS to receive up to Four Hundred Fifty Thousand Six Hundred Seven Dollars ($450,607.00) for the purpose of assisting eligible adult and senior care facilities with paying for certain operating costs and site-related improvements.  The supplemental budget before the Board will increase the overall fiscal year 2023-2024 budget for DHHS - Social Services budget unit 1160-511 in the amount of Four Hundred Fifty Thousand Six Hundred Seven Dollars ($450,607.00).  Expenditures related to the acceptance of CCE Preservation Program funding made available by the California Department of Health and Human Services are one hundred percent (100%) reimbursable.  As a result, adoption of the attached resolution, and approval of the attached supplemental budget request, will not impact to the Humboldt County General Fund.

 

STAFFING IMPACT:

The recommended actions will not impact current staffing levels.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, creating opportunities for improved safety and health, providing community-appropriate levels of service and seeking outside funding sources to benefit community needs.

 

OTHER AGENCY INVOLVEMENT:

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to adopt the attached resolution which authorizes the DHHS Director, or a designee thereof, to execute and deliver Program Funding Agreement Number 7480-CACCE-CP_2057_HUMBOLDT-01-G with HORNE as successor for Advocates for Human Potential, Inc., or its successor, as the third-Party Administrator for the CCE Preservation Program, along with any and all other agreements, certifications, attestations and documents, including, without limitation, any and all agreements with other entities, and any and all amendments thereto, that are required or deemed necessary or appropriate to evidence and secure funding made available by the California Department of Social Services through the CCE Preservation Program and the County of Humboldt’s obligations related thereto.  However, this alternative is not recommended since it would not allow the County of Humboldt to obtain funding that would be used to support adult and senior care facilities in Humboldt County.
