Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached license agreement with Mark V. Moore regarding the surface mining operation, stockpile site and temporary equipment storage area located at the Moore Quarry, Assessor Parcel Numbers 314-225-007 and 314-242-001, Showers Pass Road, Kneeland, California; and
2. Direct the Clerk of the Board to return one (1) fully executed original copy of the attached license agreement with Mark V. Moore to the Department of Public Works Land Use Division for further processing.

DISCUSSION:
The County of Humboldt has had a license agreement with the Moore Family regarding the surface mining operation, stockpile site and temporary equipment storage area located at the Moore Quarry, Assessor Parcel Numbers 314-225-007 and 314-242-001, Showers Pass Road, Kneeland, California, since 2001. The attached license agreement reflects a recent change in ownership and includes the current royalty rate and standard agreement provisions.
The attached license agreement establishes a royalty rate for pit-run aggregate at One Dollar and Twenty-Five Cents ($1.25) per cubic yard. The attached license agreement also states the standard rental rate of Fifty Dollars ($50.00) per month will be paid annually to the landowner for use of the site. Use of the site shall further include temporary onsite staging of equipment and construction materials for use on road projects in the Kneeland Ridge/Showers Pass area of Humboldt County.
The attached license Agreement shall commence upon the date of execution, with the first term extending from the date of execution through June 30, 2023. It shall renew automatically for a maximum of five (5) successive one (1) year terms based upon the same terms and conditions therein, unless either party provides written notice of non-renewal to the other party by March 31, 2023 of the current term or March 31 of any successive term.
The County of Humboldt’s Moore Quarry surface mining operation was reviewed and permitted in accordance with the California Environmental Quality Act. A Mitigated Negative Declaration was adopted by the Humboldt County Planning Commission, for the approval of Conditional Use, Surface Mining, and Reclamation Plan permits on March 5, 2009. The attached license agreement requires that the County of Humboldt remain in compliance with all permit conditions at all times.
If at any time during the term of the agreement it is determined that the site is no longer of value to the County of Humboldt, the right not to renew the attached license agreement will be exercised.
FINANCIAL IMPACT:
The attached license agreement provides for royalty payments and annual site rental payments to be made payable to Mark V. Moore, Successor Trustee. Site rental payments are Six Hundred Dollars ($600.00) per year for a total of Three Thousand Dollars ($3,000.00) over the five (5) year term of the attached license agreement. Royalty payments are expected to remain fairly consistent, so the total anticipated cost of this License Agreement is approximately Fifteen Thousand Dollars ($15,000.00). The Roads maintenance budget 1200-325 shall bear the cost of all payments made pursuant to the terms and conditions of the attached license agreement. As a result, approval of the attached license agreement will not impact to the Humboldt County General Fund.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by providing for and maintaining infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached license agreement with Mark V. Moore regarding the surface mining operation, stockpile site and temporary equipment storage area located at the Moore Quarry, Assessor Parcel Numbers 314-225-007 and 314-242-001, Showers Pass Road, Kneeland, California. However, this alternative is not recommended due to the County of Humboldt’s need for aggregate resource sites.
