RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Grant a waiver of the Nuclear Free Ordinance;

2.                     Authorize the Chair of the Board to sign and execute the attached Sheriff’s Woodley Island Berthing Permit and Rental Agreement; and

3.                     Direct the Clerk of the Board to return the executed Sheriff’s Woodley Island Berthing Permit and Rental Agreement to Public Works - Real Property, for transmittal to the Humboldt Bay Harbor, Recreation and Conservation District.

DISCUSSION:

On May 18, 2021, your Board approved the Sheriff’s Woodley Island Berthing Permit and Rental Agreement to utilize a 50-foot moorage facility for its boat, the term of which will expire on June 30, 2022. The boat is used to enforce state and local boating regulations, inspection of vessels and search and rescue operations.  

 

Staff is requesting Board approval and execution of a new Woodley Island Berthing Permit and Rental Agreement for continued use of the 50-foot moorage facility for the period of July 1, 2022 through and including June 30, 2023.

 

A waiver of the Nuclear Free Ordinance is requested because the Boating Unit has decided to use the Marina’s standard slip rental agreement, which does not contain the Nuclear Free Ordinance language.

 

FINANCIAL IMPACT:

Current annual rent for fiscal year 2021-22 is $3,486. This consists of an annual Float Replacement charge of $306, Dredge Surcharge of $906 and Moorage fee of $2,274.  New annual rent effective July 1, 2022 for fiscal year 2022-23 will be $3,630 a year.  This will consist of a Float Replacement charge of $318, Dredge Surcharge of $942 and Moorage fee of $2,370.  The rental costs will be paid with funds from the Boating Safety and Enforcement Financial Aid Program in the Sheriff’s Boating Safety budget (1100-221900).

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by providing for and maintaining infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Your Board may decide not to approve this rental agreement.  However, this alternative is not recommended as Woodley Island is an ideal location from which to operate the boat due to its proximity to other boat users, availability of parking for Sheriff’s vehicles, equipment, meetings and communications with the Harbor District stationed at the Marina
