RECOMMENDATION(S):Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute, the attached fourth amendment to the professional services Agreement with John T. Haskett dated July 6, 2022 regarding the provision of non-emergency medical care services to patients at the County of Humboldt’s psychiatric health facility in an amount not to exceed One Hundred Nine Thousand Dollars ($109,000.00) for the period of July 6, 2022 through June 30, 2027; and
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the professional services agreement with John T. Haskett dated July 6, 2022, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute professional services agreements that are substantially similar to the professional services agreement with John T. Haskett dated July 6, 2022, and any amendments thereto, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
4. Direct the Clerk of the Board to electronically provide the Department of Health and Human Services - Contract Unit with one (1) fully executed certified copy of the Board order related to this item.

DISCUSSION:
Pursuant to Section 77061(d) of Title 22 of the California Code of Regulations, the County of Humboldt’s psychiatric health facility is required to have a physician on-call at all times for the provision of non-emergency physical health care. Additionally, Section 77133(d) of Title 22 of the California Code of Regulations requires that all patients must receive a physical examination within 24 hours of their admission the County of Humboldt’s psychiatric health facility.
On July 6, 2022, the County of Humboldt, by and through its Department of Health and Human Services - Behavioral Health (DHHS - Behavioral Health), entered into a professional services agreement with John T. Haskett regarding the provision of non-emergency medical care services to patients at the County of Humboldt’s psychiatric health facility for the period of July 1, 2022 through June 30, 2023. DHHS - Behavioral Health subsequently amended the professional services agreement with John T. Haskett dated July 6, 2022 in order to extend the term thereof and increase the maximum amount payable thereunder on March 27, 2023, March 7, 2024, and April 9, 2025.
The attached fourth amendment to the professional services agreement with John T. Haskett dated July 6, 2022 will allow for the continued provision of non-emergency medical care services to patients at the County of Humboldt’s psychiatric health facility for the period of July 1, 2022 through June 30, 2027.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached fourth amendment to the professional with John T. Haskett dated July 6, 2022 regarding the provision of non-emergency medical care services to patients at the County of Humboldt’s psychiatric health facility for the period of July 1, 2022 through June 30, 2027. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments, and additional professional services agreements that are substantially similar, to the professional services agreement with John T. Haskett dated July 6, 2022, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed non-emergency medical care services.

The attached fourth amendment to the professional services agreement with John T. Haskett dated July 6, 2022 increases the maximum amount payable thereunder from Eighty-Nine Thousand Dollars ($89,000.00) to One Hundred Nine Thousand Dollars ($109,000.00) for the period of July 1, 2022 through June 30, 2027. In no event shall the maximum amount paid under the professional services agreement with John T. Haskett dated July 6, 2022 exceed Twenty-Four Thousand Dollars ($24,000.00) per fiscal year for fiscal years 2022-2023 through 2024-2025, Seventeen Thousand Dollars ($17,000.00) for fiscal year 2025-2026 and Twenty Thousand Dollars ($20,000.00) for fiscal year 2026-2027. However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the professional services agreement with John T. Haskett dated July 6, 2022 in its entirety.
Expenditure appropriations related to the attached fourth amendment to the professional services agreement with John T. Haskett dated July 6, 2022 have been included in the proposed fiscal year 2026-2027 budget for DHHS - Behavioral Health budget unit 1170-495. Funding for the attached fourth amendment to the professional services agreement with John T. Haskett dated July 6, 2022 is available through Medicare and Medi-Cal federal financial participation and state realignment and Mental Health Services Act revenues received by DHHS - Behavioral Health.
STAFFING IMPACT:
Approval of the attached fourth amendment to the professional services agreement with John T. Haskett dated July 6, 2022, will not impact current staffing levels.
OTHER AGENCY INVOLVEMENT:
None
ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached fourth amendment to the professional services agreement with John T. Haskett dated July 6, 2022 regarding the provision of non-emergency medical care services to patients at the County of Humboldt’s psychiatric health facility. However, this alternative is not recommended since it will cause DHHS - Behavioral Health to be out of compliance with applicable local, state and federal laws, regulations and standards.
