DISCUSSION:

Sempervirens Psychiatric Health Facility is a 16-bed psychiatric hospital facility operated by the County of Humboldt through its Department of Health and Human Services - Behavioral Health Branch. The Joint Conference Committee, formed under the Humboldt County Behavioral Health Bylaws of Medical Staff, is comprised of the Behavioral Health Director, two county Supervisors, the Medical Director, Behavioral Health Deputy Director, Quality Improvement (QI) Coordinator and Hospital Administrator. Oversight of Sempervirens PHF has been provided by the Joint Conference Committee, including the two members of the Board of Supervisors as specified in the bylaws. 

 

On Jan. 4, 2024, the Center for Medicare and Medicaid Services (CMS) conducted a routine audit at Sempervirens. One result of the audit was a determination that the designation of governing body and role of the Joint Conference Committee was not as explicitly clear as required. As a result, staff has prepared a resolution to codify what has been the ongoing understanding of the Board of Supervisors, DHHS staff, and the Joint Conference Committee: that Joint Conference Committee is the Governing Body for Sempervirens PHF,  two members of the Board of Supervisors are members of the JCC, and the JCC is responsible for reporting to the Board of Supervisors on all matters concerning SV that may require the attention of the Board of Supervisors. 

 

Accordingly, staff recommends adopting the attached resolution that designates the Joint Conference Committee as the governing body of Sempervirens, and authorizing the Joint Conference Committee to approve all subsequent revisions to the DHHS - Behavioral Health Bylaws of Medical Staff. The only change to current practice and understanding reflected in the resolution is an increase in meeting frequency from annual to quarterly.

There is no direct financial impact that would result from passing the attached Resolution of the Board of Supervisors of the County of Humboldt to Designate the Joint Conference Committee as the Governing Body of Sempervirens Psychiatric Health Facility.
