RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Retroactively approve, and authorize Chair of the Board to execute, the Professional Services Agreement with the CFMG regarding the provision of JBCT services in the Humboldt County Correctional Facility in the amount of $3,344,252.24 for the period of July 1, 2022 to June 30, 2025 (attachment 1);

2.                     Authorize the Sheriff, Correctional Captain, or Deputy Director of Sheriff’s Administration to execute any and all subsequent amendments to the attached Professional Services Agreement with CFMG, after review and approval by County Counsel, Risk Management and the County Administrative Office; and

3.                     Direct the Clerk of the Board to return one fully executed original copy of the attached Professional Services Agreement with CFMG to HCCF, Attn: Captain Duane Christian for further processing.

DISCUSSION:

In September 2020, the HCCF opened its 6-bed JBCT program, fully funded by DSH, subcontracting for JBCT services with CFMG.  Since then, the JBCT has restored numerous inmates to competency to prepare them for trial, significantly shortening the time inmates previously spent waiting for a bed at a state hospital.  This program has been a huge benefit to the patients, the correctional facility and DSH.

 

DSH has agreed to continue to fund the JBCT and expand from six beds to eight, as Humboldt County continues to see an increase in those declared incompetent to stand trial.  Your Board approved the contract between DSH and the HCCF on June 28, 2022 (22-734).  This agreement is for CFMG to continue to provide JBCT services for the HCCF, and needs to be retroactive to July 1, 2022 to compensate CFMG for services rendered since the expiration of the previous contract, avoiding a lapse in treatment to the patients. This agreement is coming before your Board retroactively due to delays in finalizing the DSH contract funding this agreement which was approved on June 28, 2022.

 

JBCT services will be provided to inmates facing felony charges who have been declared “Incompetent to Stand Trial” (IST).  These services include competency training, individual therapy and group sessions, with the goal of stabilizing the patients and helping them understand the court process to assist their attorneys with their defense.

 

Accordingly, the HCCF recommends that the Board of Supervisors approve, and authorize the Chair to execute, the attached Professional Services Agreement with CFMG regarding the provision of JBCT services for the period of July 1, 2022 to June 30, 2025. Staff also recommends that the Board authorize the Sheriff, Correctional Captain, or Deputy Director of Financial and Support Services to execute any and all subsequent amendments to the attached Professional Services Agreement with CFMG, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed JBCT services.

 

FINANCIAL IMPACT:

The HCCF contract with DSH previously approved by your Board is for a total of $5,077,367.44 payable to HCCF for JBCT services over three years (attachment 2).  HCCF’s sub-contract with CFMG has a total payable amount of $3,344,252.24 for the period of July 1, 2022 to June 30, 2025.  HCCF will pay CFMG a Daily Rate of $325.03 per bed for the cost of clinical providers, on-site labs/supplies, and medications.  HCCF will also pay CFMG a one-time $15,000.00 for expansion costs, an annual $6,000.00 in replenishment costs, and an annual $153,796.40 for Long Acting Injectables. This leaves $1,733,115.20 to cover services provided by HCCF to include the cost of 1.0 FTE Correctional Deputy dedicated to JBCT, cost of housing, and cost of expansion and replenishment.  The annual amounts are listed in the below table.

 

                                 

 

In the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached Professional Services Agreement with CFMG.

 

Expenditure appropriations related to the attached agreement has been included in the FY 2022-2023 budget for the Sheriff JBCT budget, 1100-243200, and will be included in the upcoming budgets for the life of the contract.  Funding for the attached Professional Services Agreement with the CFMG is available through State Standard Agreement 22-79005-000 with DSH.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the agreement or allow the Chair to sign such agreements, however this alternative is not recommended as it will deny the incarcerated IST population quicker access to competency restoration services and once again lead to a backlog of IST inmates awaiting placement in the overcrowded state hospital system.
