RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve the attached plans and specifications for the Shively Road (C4F012) at Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project; and
2. Find that the Shively Road (C4F012) at Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project is exempt from environmental review under the California Environmental Quality Act pursuant to Sections 15269(a) and 15302 of Title 14 of the California Code of Regulations; and
3. Direct the Clerk of the Board to advertise the Shively Road (C4F012) at Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project as required by Section 22037 of the California Public Contract Code, with bids to be opened on Tuesday, Jun. 30, 2026, at 2:00 p.m.

DISCUSSION:
This project combines two separate disaster declarations: Feb. 14, 2017, and Dec. 20, 2022, the Governor of the State of California declared disasters for Humboldt County due to severe winter storms, flooding and mudslides, and a magnitude 6.4 earthquake which occurred off the Northern California coastline. Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25, located near the town of Scotia, experienced roadway damage.
Shively Road (C4F012) Post Mile 0.52 was previously advertised on Mar. 23, 2021, combined with Post Miles 3.50, 3.51, 7.90, and 8.42. The contract was awarded to GR Wilcox Enterprises, Inc, however, Post Mile 0.52 was not constructed because the county had not received a response from Federal Emergency Management Agency (“FEMA”) regarding a scope and cost change. Consequentially, the planned repair at Post Mile 0.52 was removed from the 2021 contract via change order.
Shively Road (C4F012) Post Mile 0.52 was redesigned and advertised on April 25, 2023; however, FEMA’s Environmental Planning and Historic Preservation cadre had not finished reviewing the revised project scope submitted by the county.
On Oct. 6, 2025, the Humboldt County Department of Public Works (“Public Works”) received FEMA funding approval to proceed with the Shively Road (C4F012) Post Mile 0.52 storm damage repair project. On April 14, 2023, Public Works received California Governor’s Office of Emergency Services (”CalOES”) funding approval to proceed with the Shively Road (C4F012) Post Miles 3.00 to 3.25 earthquake repair project. Public Works subsequently prepared the attached plans and specifications for the project based on topographic surveys of the damaged areas prepared by Points West Surveying Company.
The work proposed in the attached plans and specifications at Shively Road (C4F012) Post Mile 0.52 consists of tree removal, retreating the roadway, placement of a culvert, reconstruction of the roadway, and implementation of erosion control measures. At Shively Road (C4F012) Post Miles 3.00 to 3.25, the work consists of constructing geosynthetic reinforced embankment, reconstructing the roadway and implementation of erosion control measures.
The Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project involves the replacement and reconstruction of existing road infrastructure at the same site as it existed prior to suffering damage and is within the scope of the disaster declarations made by the Governor of California on Jan. 23, 2017, and on Dec. 20, 2022. Such work is considered exempt from environmental review under the California Environmental Quality Act pursuant to Sections 15269(a) and 15302 of Title 14 of the California Code of Regulations.
Accordingly, Public Works recommends that the Board of Supervisors approve the attached plans and specifications for the Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project; find the Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project is exempt from environmental review under the California Environmental Quality Act pursuant to Sections 15269(a) and 15302 of Title 14 of the California Code of Regulations; and direct the Clerk of the Board to advertise the Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project as required by Section 22037 of the California Public Contract Code, with bids to be opened on Tuesday, Jun. 30, 2026, at 2:00 p.m.

Narrative Explanation of Financial Impact:
There is no financial commitment until the Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project is awarded. The Shively Road (C4F012) Post Mile 0.52 Storm Damage Repair Project is being funded by the Federal Emergency Management Agency (75%), California Governor’s Office of Emergency Services (18.75%) and the Humboldt County Road Fund - Measure O (6.25%). Shively Road (C4F012) Post Miles 3.00 to 3.25 Earthquake Repair Project is being funded by California Governor’s Office of Emergency Services funding (75%) and the Humboldt County Road Fund - Measure O (25%). The engineer’s cost estimate for the project is $438,020.00. The Humboldt County Road Fund will be responsible for $74,993.00. Expenditure appropriations related to completion of the Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project are included in the proposed fiscal year 2026-27 budget for Roads Engineering, 1200-321.
Humboldt County adopted county-wide local transactions and use tax (sales tax) through an affirmative vote on a local measure known as Measure O. Public Works will use Measure O funds for the grant match portion of the project.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board of Supervisors may choose not to approve the attached plans and specifications for the Shively Road (C4F012) Post Mile 0.52 and Post Miles 3.00 to 3.25 Storm Damage and Earthquake Repair Project. However, this alternative is not recommended since the project will restore the roadway to pre-disaster conditions using funds that would not otherwise be available to the County of Humboldt.
