That the Board of Supervisors:
1. Authorize Hank Seemann, Public Works Deputy-Director, to sign a Notice of Intent to submit an application for a new license for the Potter Valley Project pursuant to the terms and conditions of the Amended Planning Agreement dated June 18, 2019.

DISCUSSION:
On June 18, 2019, the Board approved and authorized the execution of an Amended Planning Agreement to study the feasibility of forming a regional entity to develop a potential license proposal for the Potter Valley Project. Parties to the Amended Planning Agreement include California Trout, Inc., Mendocino County Inland Water and Power Commission and Sonoma County Water Agency. Additional parties may be added in the future. According to the Amended Planning Agreement, the parties will submit a Notice of Intent to the Federal Energy Regulatory Commission on or before July 1, 2019, to file an application for a new license for the Potter Valley Project. The parties are submitting the Notice of Intent as proxies for a potential new regional entity that would be the license applicant. The parties anticipate completing the feasibility study by April 14, 2020. Based on the current proposed schedule the new regional entity would file the license application by April 14, 2022.
FINANCIAL IMPACT:
Today’s recommendation will not impact the Humboldt County General Fund. Signing the Notice of Intent does not commit Humboldt County to participate in the potential new regional entity. Funds to support the feasibility study have been incorporated into the proposed Fiscal Year 2019-20 budget. The results of the feasibility study will be brought to the Board for review and direction.
STRATEGIC FRAMEWORK:
The recommended action supports the Board of Supervisors’ Strategic Framework by providing for and maintaining infrastructure and creating opportunities for improved safety and health.
OTHER AGENCY INVOLVEMENT:
Many federal, state and local agencies and tribal governments.
