RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Adopt the resolution authorizing the Director of Public Health, or their designee, to apply for funding for the next five fiscal years (2024-25 through 2028-29) from CalRecycle (See Attachment 1);

2.                     Approve and authorize the DHHS-Public Health Director, or a designee thereof to enter into and execute grant agreements and grant agreement amendments with CalRecycle for DEH’s LEA program, in Fund 1175, Budget Unit 430 after review and approval by County Counsel and Risk Management;

3.                     Authorize the Department of Health and Human Services Director of Public Health, or designee thereof to execute all subsequent amendments, and any other agreements, certifications, attestations, and documents directly related to the grant agreements, after review of County Counsel and Risk Management; and

4.                     Direct the Clerk of the Board to return one certified original, signed copy of the resolution to Public Health Administration.

DISCUSSION:

CalRecycle administers a grant program which allows public agencies to seek financial assistance for the cleanup of eligible solid waste sites on farm or ranch properties as defined in 14 CCR Section 17991, where cleanup is needed to protect public health and the environment. No farm or ranch property is eligible for a grant if it is determined that the owner was responsible for the illegal disposal. Eligible costs include excavation, erosion control, waste removal and disposal, recycling, site security and project management. CalRecycle requires that a Resolution authorizing the submission of grant applications, and acceptance of any grant funds, be adopted as part of the grant application process.

 

Your Board previously approved Resolution No. 19-42 on May 28, 2019 (Attachment 2) and similar resolutions regarding this grant program in 2005, 2009, and 2014. Past projects implemented by DEH and funded by the grant program include: cleanup and restoration of a nuisance dumpsite on private property used for cattle grazing and timber production along Wildcat Road, south of Ferndale; twelve dump sites on Pacific Lumber Company land along Shively and Kneeland Roads; Green Diamond Resource Company’s Holmes-Davis Dump site on Fickle Hill Road; and Redwood House Road dumpsite on Humboldt Redwood Company land.

Narrative Explanation of Financial Impact:

Adoption of this resolution will give DEH the ability to apply for grant funds for the next five fiscal years. The grant funds are limited to $50,000 per project site, with a maximum of $200,000 per year for each jurisdiction. This grant is administered through Fund 1175, Budget Unit 430002 and is not currently included in the proposed county budget for fiscal year 2023-24, but is expected to be budgeted in subsequent fiscal years. DEH will apply for and administer the grants on behalf of local property owners. DEH will be reimbursed for time spent on project management and up to 7% of the total Grant amount for administration of each cleanup project. As there is no reimbursement by the State for grant application and preparation, the Board has previously approved a Cleanup Grant Eligibility Review fee of $980 in the county fee schedule for the LEA’s work in determining whether a site is eligible for grant application.

There are no anticipated impacts on staffing directly associated with the adoption of this resolution or the related grants.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose to not approve this Resolution. This is not recommended, as the loss of funding would result in the loss of the ability to respond to cleanup opportunities of illegal solid waste sites on farm or ranch properties.
