RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and ratify the Director of Public Works’ execution of, Contract Change Order Number 1 for the total amount of $138,514.80 (4/5 Vote Required); and
2. Accept the completed contract, including any and all approved change orders, with Kernen Construction, regarding the construction of Public Works Measure O - 2026 Road Maintenance Surfacing Project Bald Hills Road (Phase 1); and
3. Approve the final claim for payment, to be submitted by the Department of Public Works to the Auditor-Controller’s Office, in the amount of $100, which will bring the total amount paid to 100% of the contract; and
4. Direct the Clerk of the Board to provide the Roads Division of the Department of Public Works with one fully executed certified copy of the Board order related to this item.

DISCUSSION:
The Public Works Measure O - 2026 Project consists of Phase I improvements consisting of Hot Mix Asphalt overlay leveling course on Bald Hills roadway surface.
On March 24, 2026, the Humboldt County Board of Supervisors ("Board") authorized the Clerk of the Board to advertise the Public Works Measure O - 2026 Road Maintenance Surfacing Project - Bald Hills Road (Phase 1) for bids. On April 14, 2026, the County of Humboldt received five (5) bids for the project. On April 28, 2026, the Board awarded the construction contract to Kernen Construction, the lowest responsive and responsible bidder, in the amount of $1,059,570.00.
During construction, contract change orders totaling $138,514.80 were executed, increasing the final contract amount from $1,059,570.00 to $1,198,084.80. The cumulative cost of these change orders exceeds the authorized contingency by $32,557.80. While this change order exceeded the authorized approval limit, the final contract amount remains below the original approved budget established in the Board approved advertisement request. The additional work consisted primarily of extending pavement surfacing beyond the original project limits to rehabilitate deteriorated pavement immediately adjacent to the planned limits. Although the additional work resulted in costs exceeding the authorized contingency, it was determined to be in the County's best interest because it improves the long-term performance and service life of the roadway.
The additional work also protects the County's investment in the project within the roadway that is affected by the Highway Safety Improvement Program (HSIP) Edgeline on Indian Reservation Road System Project, which has been awarded by this Board for construction. The HSIP project is funded at 90 percent by the California Department of Transportation's Highway Safety Improvement Program. Extending pavement improvements in conjunction with the HSIP project promotes long-term roadway preservation and maximizes public funds invested in the roadway.
Accordingly, Public Works recommends that the Board: accept the completed contract, including all approved change orders, and approve the final claim for payment in the amount of $100.

Narrative Explanation of Financial Impact:
Total construction costs for the Public Works Measure O - 2026 Road Maintenance Surfacing Project Bald Hills Road (Phase 1) are $1,198,084.80. Progress payments totaling $1,197,984.80 have been paid, and the final claim for payment in the amount of $100 is outstanding. The Public Works Measure O - 2026 Road Maintenance Surfacing Project Bald Hills Road (Phase 1) is funded by Measure O Funds (100%). Expenditure appropriations relating to completion of the Public Works Measure O - 2026 Road Maintenance Surfacing Project Bald Hills Road (Phase 1) Project are included in the approved fiscal year (FY) 2025-2026 Public Works Measure O Budget (1200342).
STAFFING IMPACT:
The recommended actions will not impact current staffing levels.
ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board of Supervisors may choose not to accept the Public Works Measure O - 2026 Road Maintenance Surfacing Project Bald Hills Road (Phase 1) final payment. However, this alternative is not recommended because the project has been completed, and the recommended actions are needed to accept the contract.
