RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Adopt the attached resolution (Resolution 21-__ (Attachment 1)) making all the required findings for approval of the Discharge of Firearms Ordinance and Target Shooting Ordinance amendments;

2.                     Adopt the attached ordinance (Ordinance No. ____ (Attachment 2)) amending the existing Discharge of Firearms Ordinance Section 915-6 of Chapter 5 of Division 1, Title IX of Humboldt County Code and the Target Shooting Ordinance Section 915.5-7 of Chapter 5.5 of Division 1, Title IX of Humboldt County Code;

3.                     Direct the Planning and Building Department to file a Notice of Exemption with the Humboldt County Recorder’s Office, and

4.                     Direct the Clerk of the Board to publish a summary of the Ordinance amendments within 15 days after adoption by the Board, along with the names of those Supervisors voting for and against each ordinance (Attachment 3) and to post in the Office of the Clerk of the Board of Supervisors a certified copy of the full text of the adopted ordinance along with the names of those Supervisors voting for and against the ordinance.

SOURCE OF FUNDING                     

The salary funding for preparing this staff report is included in the General Fund contribution to the Long-Range Planning unit, 1100-282. 

 

DISCUSSION:

This item follows up the Board of Supervisor’s direction from Item # J-1 of the May 25, 2021 meeting when the Board set in motion adoption of the attached amendments to the existing Target Shooting Ordinance to include the prohibition of shooting within 150 yards from any occupied structure and heavily used recreational areas, and expanding the prohibition of shooting of a firearm to include the Samoa Peninsula.  The recommended action will complete adoption of these amendments.

 

Environmental Review

This project is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 1061. The Common Sense Exemption which states CEQA applies only to projects which have the potential for causing a significant effect on the environment.

 

FINANCIAL IMPACT:

Staff costs and other expenses related to preparation and review of this agenda item total approximately $1,000.
