RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Accept the completed contracts, including all change orders approved by the Public Works Department, between GR Wilcox Enterprises, Inc., and Humboldt County for construction of Storm Damage Repair to Shively Road Post Miles 0.52, 3.50, 3.51, 7.90, and 8.42; and

2.                     Approve the final claims for payment, to be submitted by the Public Works Department to the Auditor/Controller, in the amounts of $1,085.69 for Post Mile 3.50, $590.20 for Post Mile 3.51, $191.35 for Post Mile 7.90, and $981.92 for Post Mile 8.42, which will bring the total amount paid to 100 % of the contracts.

DISCUSSION:

On Feb. 14, 2017, the Federal Emergency Management Agency declared a disaster for Humboldt County due to severe winter storms, flooding, and mudslides.  Shively Road (C4F012) Post Miles 0.52, 3.50, 7.90, and 8.42, located near the communities of Scotia and Shively in the central area of Humboldt County, experienced roadway failures due to saturated embankment soils slipping beneath the roadway and heavy rainfall overwhelming existing drainage facilities. The embankment failures resulted in lane closures and additional hazards to commuters on Shively Road. Additionally, heavy rains from another federally declared disaster on Feb. 24, 2019, caused new damage at Shively Road Post Mile 3.51.

 

Between April 10, 2018, and April 21, 2020, the Humboldt County Department of Public Works (“Public Works”) received funding approval from the Federal Emergency Management Agency to proceed with the Shively Road (C4F012) Post Miles 0.52, 3.50, 3.51, 7.90, and 8.42 Storm Damage Repair Project.  Public Works prepared plans and specifications for the project based on topographic surveys of the damaged areas prepared by Humboldt County Public Works Survey Division and geotechnical studies prepared by Crawford and Associates. The work consisted of constructing rock buttresses, replacing culverts, installing subsurface drainage, restoring the road surface to pre-disaster conditions with aggregate base and hot mix asphalt, and installing sediment and erosion control items.

 

On March 23, 2021, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the Shively Road Post Miles 0.52, 3.50, 3.51, 7.90, and 8.42 Storm Damage Repair Project for bids. On April 27, 2021, the County of Humboldt received six (6) bids for the project. The project agreement was awarded to GR Wilcox Enterprises, Inc., the lowest responsible bidder, on May 25, 2021. The award amount was $1,830,247.88, and contract change orders executed during the project decreased the authorized amount by $1,071,311.10 for Contract Number 217535 (Post Mile 0.52), $3,900 for Contract Number 217304 (Post Mile 3.50), $4,372.56 for Contract Number 219304 (Post Mile 3.51), $12,733.20 for Contract Number 217556 (Post Mile 7.90), and $4,394.85 for Contract Number 217390 (Post Mile 8.42).

 

Public Works recommends that the Board of Supervisors accept the completed contracts, including all change orders approved by Public Works for this project, and approve the final claims for payment.

 

FINANCIAL IMPACT:

Total construction costs for this project are $733,536.17. No payments have been paid or are outstanding for Post Mile 0.52 because Public Works is redesigning this project. Progress payments totaling $406,309.61 have been paid for Post Mile 3.50, and the final claim for payment in the amount of $1,085.69 is outstanding. Progress payments totaling $225,705.78 have been paid for Post Mile 3.51, and the final claim for payment in the amount of $590.20 is outstanding.  Progress payments totaling $38,333.68 have been paid for Post Mile 7.90, and the final claim for payment in the amount of $191.35 is outstanding. Progress payments totaling $60,337.94 have been paid for Post Mile 8.42, and the final claim for payment in the amount of $981.92 is outstanding.

 

This project was funded through Federal Emergency Management Agency (FEMA) Disaster Funds (75%), the California Governor’s Office of Emergency Services (18.75%), and the Humboldt County Road Fund (6.25%). Expenditure appropriations relating to completion of the Shively Road Post Miles 0.52, 3.50, 3.51, 7.90, and 8.42 Storm Damage Repair Project are included in the Fiscal Year 2021-22 Road Fund Budget (1200321-2118).

 

Projects are paid in arrears with anticipated funding coming through FEMA and California Governor’s Office of Emergency Services as mentioned above. The FY 2020-21 annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $5.9 million. This is due to the timing of when FEMA reimburses the county. It can take years for the county to receive repayment of the 75% FEMA match. The department utilizes other state and local funding, such as the Regional Surface Transportation Program funds, for the 6.25% Humboldt County Road Fund match for FEMA projects.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to accept the Shively (C4F012) Road Post Miles 0.52, 3.50, 3.51, 7.90, and 8.42 Storm Damage Repair Projects. However, staff does not recommend this alternative because the project has been completed, and the requested Board actions are needed to accept the contracts.
