Recommendation
That the Board of Supervisors:
1. Appoint Joaquin Courtemanche to fill the vacancy on the Briceland Community Services District (CSD) governing board for the remaining two years, ending the first Friday of December 2020.

DISCUSSION:
Governing board member, Linda Feretto, resigned from the Briceland CSD board on July 8, 2019. Pursuant to Government Code, Section 1780 (d)(1), the Briceland CSD posted notice of the vacancy in three conspicuous places in the district for 15 days. Government Code, Section 61040, requires government board members to be registered voters and reside within the district boundary. Briceland CSD did not receive any interest from registered voters who reside in the district.
Briceland CSD did receive interest from Joaquin Courtemanche. Mr. Courtemanche is a new owner of an annexed parcel in the district’s sphere of influence. Mr. Courtemanche’s residence has historically been served by Briceland CSD and he currently pays for water from Briceland CSD.
Pursuant to Government Code, Section 1780 (f)(1), when a vacancy is not filled by the district board by appointment, the board of supervisors of the county may appoint a person to fill the vacancy within 90 days of the date of the vacancy. Government Code, Section 24001, authorizes the board of supervisors to waive Government Code, Section 61040, for an appointed district office when it finds that the best interests of the district will be served. Briceland CSD believes Joaquin Courtemanche would make a great addition to the governing board and requests your board appoint Mr. Courtemanche to fill the vacancy.

This appointment will not have an impact on the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your board could choose not to make this appointment to the Briceland Community Services District and instead choose to call an election to fill the vacancy. This option is not recommended as no registered voters in the district have applied for the office and it would create an undue financial hardship on the district.
