RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Retroactively approve, and authorize the Chair of the Board to execute the Professional Service Agreement between HCCF and Recovery Solutions regarding JBCT services in the amount of $2,854,126.38 for the period of Jan. 1, 2026 to Dec. 31, 2028 (Attachment 1); and
2. Authorize the Sheriff, Correctional Captain or Deputy Director Financial and Support Services, to execute any and all subsequent amendments, extensions, revisions or termination to the attached Professional Service Agreement with HCCF and Recovery Solutions after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one fully executed original copy of the attached Professional Service Agreement with HCCF and Recovery Solutions to HCCF, Attn: Captain Duane Christian for further processing.

DISCUSSION:
In September 2020, the HCCF opened its 6-bed JBCT program, fully funded by DSH, subcontracting for JBCT services with California Health and Recovery Solutions, P.C. (“Recovery Solutions”). Since then, the JBCT has restored numerous inmates to competency to prepare them for trial, significantly shortening the time inmates previously spent waiting for a bed at a state hospital. This program has been a huge benefit to the patients, the correctional facility and DSH. DSH has agreed to continue to fund the JBCT for 8 beds, as Humboldt County continues to see an increase in those declared “Incompetent to Stand Trial” (IST). Recovery Solutions will continue to provide the JBCT services pursuant to a separate service agreement.
JBCT services will continue to be provided to inmates facing felony charges who have been declared IST. These services include competency training, individual therapy and group sessions, with the goal of stabilizing the patient and helping them understand the court process to assist their attorneys with their defense.
Accordingly, the HCCF recommends that the Board of Supervisors approve, and authorize the Chair to execute, the attached Professional Service Agreement with Recovery Solutions regarding the provision of JBCT services for the period of Jan. 1, 2026 to Dec. 31, 2028. Staff also recommends that the Board authorize the Sheriff, Correctional Captain, or Deputy Director Financial and Support Services, to execute any and all subsequent amendments to the attached Professional Service Agreement with Recovery Solutions, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed JBCT services.
This agreement is before your Board after the start date for retroactive approval due to delays in the contract process with the Department of State Hospitals which had to be executed prior to this agreement.

Narrative Explanation of Financial Impact:
For Fiscal Year (FY) 2025-26, $478,444 was paid for these services under the previous agreement. $461,698 will be paid from January to June 2026 for a total of $940,142. Sufficient funds were previously budgeted and a supplemental is not needed. For FY 2026-27 the total to be paid is $937,248 and FY 2027-28 is $965,365. The contract runs on a calendar year so only the first half of FY 2028-29 is covered by this agreement for a total of $489,816. The maximum payable for this 3-year agreement is $2,854,127 which is 100% reimbursed by the Department of State Hospitals.
STAFFING IMPACT:
There is no impact to county staffing. These services are currently being provided by Recovery Solutions and are recommended to continue to do so.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the agreement, however this alternative is not recommended as it will deny the incarcerated IST population quicker access to competency restoration services and once again lead to a backlog of IST inmates waiting placement in the overcrowded state hospital system.
