That the Board of Supervisors:

1.                     Consider the appointment to the Shelter Cover Resort Improvement District.

DISCUSSION:

On July 22, 2024 the Clerk of the Board’s office was notified that a vacancy occurred on the Shelter Cove Resort Improvement District.  The vacancy was posted, and applications were accepted. 

 

Pursuant to Section 13036 of the California Public Resources Code “all vacancies in the office of director shall be filled by appointment by the Board of Supervisors.” Section 13037 of the Californian Public Resources Code provides that “an appointment to fill a vacancy in the office of director shall be for the unexpired term of the office in which the vacancy exists, and until the election or appointment of his successor.”

 

The Shelter Cove Improvement District received only one application from Jeff Hildreth. Hildreth meets the requirements for serving on the Shelter Cover Resort Improvement District’s Board of Directors set forth in the California Public Resources Code Section 13035. The Shelter Cove Resort Improvement District has reviewed the application and have submitted a letter of recommendation to appoint Jeff Hildreth to the position (Attachment 3). This is an at large appointment; therefore, it is the Board’s discretion to proceed.

 

Hildreth’s application is attached (Attachment 2). The applicant has been invited to attend the meeting if he desires.

FINANCIAL IMPACT:

Narrative Explanation of Financial Impact:

There are no direct costs associated with making an appointment to the board of directors for the Shelter Cover Resort Improvement District.  As a result, the recommended action will not impact the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board could push the appointment to another meeting to add time for more applications.  This is not recommended as the posting has been up for 30 days to meet the legal Maddy Act rules.
