RECOMMENDATION(S):Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute, the attached fifth amendment to the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012 regarding the provision of emergency evacuation services for the period of June 1, 2012 through July 30, 2030; and
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to provide the Department of Health and Human Services - Contract Unit with one (1) fully executed certified copy of the Board order related to this item.

DISCUSSION:
The Centers for Medicare and Medicaid Services require the Humboldt County Department of Health and Human Services - Behavioral Health (“DHHS - Behavioral Health”) to enter into a written agreement with a qualified institution, organization or agency regarding the evacuation of patients from the County of Humboldt’s psychiatric health facility in the event of an emergency which renders such facility inoperable or uninhabitable.
On July 2, 2012, the County of Humboldt, by and through DHHS - Behavioral Health, entered into a memorandum of Understanding with Crestwood Behavioral Health, Inc. regarding the provision of emergency evacuation services for the period of June 1, 2012 through May 31, 2016. The Humboldt County Board of Supervisors (“Board”) and DHHS - Behavioral Health subsequently amended the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012 four (4) times in order to extend the term thereof and modify the execution requirements, and update the contact information, set forth therein.
The attached Fifth amendment to the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012 will allow for the provision of emergency evacuation services in the event of an emergency which renders the County of Humboldt’s psychiatric heath facility inoperable or uninhabitable through June 30, 2030.
Accordingly, the DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached fifth amendment to the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012 regarding the provision of emergency evacuation services for the period of June 1, 2012 through June 30, 2030. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed emergency evacuation services.

Behavioral Health Fund (1170-495)
FINANCIAL IMPACT:
In the event of a fire, natural disaster or other emergency requiring evacuation of the County of Humboldt’s psychiatric health facility, the costs associated with evacuating, transporting patients to Crestwood Behavioral Health’s facilities would be funded through bed day revenues received by DHHS - Behavioral Health in accordance with the terms and conditions of the County of Humboldt’s current placement services agreement with Crestwood Behavioral Health, Inc.
STAFFING IMPACT:
Approval of the attached fifth amendment to the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012 will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose to not approve the attached fifth amendment to the memorandum of understanding with Crestwood Behavioral Health, Inc. dated July 2, 2012 regarding the provision of emergency evacuation services. However, this alternative is not recommended since it could result in delaying the evacuation of patients from the County of Humboldt’s psychiatric health facility in the event of an emergency which renders such facility inoperable or uninhabitable.
