RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Waive the requirements of the Humboldt County Nuclear Free Ordinance with regard to the attached substance use services agreement with Partnership HealthPlan of California;

2.                     Approve, and authorize the Chair of the Board to execute, the attached substance use services agreement with Partnership HealthPlan of California regarding the provision of outpatient substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County as part of the Drug Medi-Cal Organized Delivery System;

3.                     Authorize the Department of Health and Human Services - Mental Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached substance use services agreement with Partnership HealthPlan of California after review and approval by County Counsel, Risk Management and the County Administrative Office; and

4.                     Direct the Clerk of the Board to return one (1) executed original copy of the attached substance use services agreement with Partnership HealthPlan of California to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:

Partnership HealthPlan of California (PHC) is the Medi-Cal Managed Care Plan for Medi-Cal beneficiaries residing in Humboldt County.  The Humboldt County Department of Health and Human Services - Mental Health (DHHS - Mental Health) has, in conjunction with seven other northern California Counties and PHC, submitted a joint regional plan regarding participation in, and implementation of, the Drug Medi-Cal Organized Delivery System to the California Department of Health Care Services and federal Centers for Medicare and Medicaid Services.  The Drug Medi-Cal Organized Delivery System is an optional program under the State of California’s Medicaid waiver that is anticipated to significantly increase federal funding available to treat Medi-Cal beneficiaries suffering from substance use disorders.  Once DHHS - Mental Health has received the appropriate agreement from the State of California, it will seek approval from the Board of Supervisors to officially opt-in to, and implement, the Drug Medi-Cal Organized Delivery System.  Implementation of the Drug Medi-Cal Organized Delivery-System is currently planned to occur on Feb. 1, 2020.

 

The attached substance use services agreement with PHC will allow DHHS - Mental Health to directly bill PHC for the provision of substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County after the Drug Medi-Cal Organized Delivery System is implemented.  It should be noted that the attached substance use services agreement with PHC does not contain a fixed term and will expire only upon the termination thereof by either party.  In addition, the Board must waive the requirements of the Humboldt County Nuclear Free Ordinance in order to approve the attached substance use services agreement with PHC, since it does not contain a provision which requires PHC to comply with the requirements set forth therein.

 

Accordingly, DHHS - Mental Health recommends that the Board approve, and authorize the Chair of the Board to execute, the attached substance use services agreement with PHC regarding the provision of outpatient substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County as part of the Drug Medi-Cal Organized Delivery System.  It is also recommended that the Board authorize the DHHS - Mental Health Director, or a designee thereof, to execute any subsequent amendments to the attached substance use services agreement with PHC, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid potential delays in the provision of needed outpatient substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County.

 

FINANCIAL IMPACT:

Pursuant to the terms and conditions of the attached substance use services agreement with PHC, DHHS - Mental Health will be compensated for outpatient substance use disorder treatment services provided at the rates set forth in the Drug Medi-Cal Substance Use Provider Fee Schedule.  Expenditure appropriations related to the attached substance use services agreement with PHC have been included in the approved fiscal year 2019-20 budget for DHHS - Mental Health Substance Use Disorder budget unit 1180-425.  As a result, approval of the attached substance use services agreement with PHC will not impact the Humboldt County General Fund.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations and creating opportunities for improved safety and health.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to approve the attached substance use services agreement with PHC regarding the provision of outpatient substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County as part of the Drug Medi-Cal Organized Delivery System.  However, this alternative is not recommended since it will not allow DHHS - Mental Health to directly bill PHC for the provision of outpatient substance use disorder treatment to eligible Medi-Cal beneficiaries after the Drug Medi-Cal Organized Delivery System is implemented.
