RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Authorize the Chair of the Board to sign, in triplicate, the License Agreement between the County of Humboldt and Yvonne D. Titus et al. (Attachment 1); and

2.                     Direct the Clerk of the Board to retain one License Agreement and return the other two to the Department of Public Works, Land Use Division for further processing.

DISCUSSION:

The License Agreement with Yvonne D. Titus et al. is for the continued use of a portion of their property on Clark Road in the Petrolia area, which has been used since 1994 for the purposes of stockpiling aggregate material for road maintenance and repair projects, and for temporary equipment storage appurtenant to said stockpiling. The previous license agreement for this site was made with parties that no longer hold title to the land, and had automatic one (1) year renewals, the latest of which expired on June 30, 2024. The new license agreement is for the remainder of the 2024-2025 fiscal year with ten (10) annual automatic renewals occurring on July 1 of each successive year.

Narrative Explanation of Financial Impact:

The new license agreement provides for annual site rental payments. These costs are borne by the Road Fund and are include in the approved fiscal year 2024-25 budget for Roads Maintenance (1200-325).

 

The Road Fund (1200) has a negative balance. This is partially due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects. Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board could choose not to execute a new lease agreement (renewal) for the existing stockpile site. However, this is not recommended as not approving this lease agreement reduces Public Works’ quantity of stockpile locations as well as the total capacity available for stockpiling. This results in needing to drive farther distances to the next closest stockpile site as well as displacing capacity at other existing stockpile sites to accommodate for the loss of this stockpile site.
