Recommendation
That the Board of Supervisors:
1. Approve Amendment 1 to Cooperative Agreement No. 24-0469-005-SF, PDCP contract between Humboldt County and the California Department of Food and Agriculture (CDFA) for the period beginning July 1, 2025, and ending Sept. 30, 2027; and
2. Authorize the Chair to sign the amendment, and direct the Clerk of the Board to return all copies to the Agricultural Commissioner’s office for further processing; and
3. Grant a waiver from the provisions of the Nuclear-Free Ordinance.

DISCUSSION:
On Sept. 9, 2025, your Board approved Cooperative Agreement No. 24-0469-005-SF which provided funding to Humboldt County for the PDCP. The amendment before your Board today increases the funding provided through Cooperative Agreement No. 24-0469-005-SF by $9,039.26 and extends the agreement period to Sept. 30, 2027. The new total of the agreement is not to exceed $22,259.45. The PDCP contract funds trapping and survey activities that are intended to protect Humboldt County’s viticulture industry from a serious disease known as Pierce’s Disease.
Pierce’s Disease is caused by the bacterium Xylella fastidiosa and is spread by the Glassy-Winged Sharphoooter (GWSS). In addition to grapes, GWSS infests many species of ornamental plants and nursery stock. To prevent the spread of Pierce’s Disease to Humboldt County, the PDCP division of CDFA monitors nursery stock and other plant product shipments into the county from areas under quarantine for GWSS. Agriculture Department staff place and inspect GWSS yellow panel traps at nurseries receiving shipments. Traps are also placed in residential areas where host species of ornamental plants are present.
The waiver from the provisions of the Nuclear Free Ordinance is requested because the State of California will not modify its “cooperative agreements” to accommodate local ordinances.

Narrative Explanation of Financial Impact:
All costs for the Pierce’s Disease Control Program for personnel, mileage and supplies will be reimbursed by the contract. Amendment 1 to cooperative agreement No. 24-0469-005-SF increases the original agreement by $9,039.29 for a new total not to exceed $22,259.45 for agriculture department activities related to GWSS activities from July 1, 2025, to Sept. 30, 2027. The department’s revenue and expenditure accounts were included in the FY 2026-27 budget in Fund 1100, Budget Unit 261 -Agricultural Commissioner in anticipation of this agreement therefore no supplemental budget accompanies this request. Costs are billed to CDFA monthly and payment is made in arrears to Humboldt County.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board may choose not to approve amendment 1 to the original agreement. However, this is not recommended as the revenue is used to reimburse county costs for the PDCP.
