RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1. Adopt the attached resolutions (Attachment 1 and 2) which do the following:

a. Rescinds the action taken on August 25, 2026, to revoke the Conditional Use Permits granted for PLN-10508-CUP and PLN-10509-CUP.

DISCUSSION:

Executive Summary

This item requests the Board of Supervisors rescind the revocation action that was taken on Aug. 25, 2026, for the Conditional Use Permits for Panther Gap Farms, Permit Numbers PLN-10508-CUP and PLN-10509-CUP.

The permits were two of 14 that the Board voted to revoke due to failure to pay outstanding Planning and Building fees. The permit was scheduled and noticed for revocation, to be heard at 9 am or as soon thereafter as the matter could be heard. The permit holder contacted the Planning and Building Department at approximately 9:15 am and the past due amounts for both permits were processed at 9:21 am. The Board took action to revoke the permits at approximately 10:05 am, meaning that the cause for the revocation of these permits had been addressed by the time of the Board’s action, and no longer existed at the time the Board took action. Therefore, there was not cause to revoke the permit and the permit was revoked in error. As the operator paid the fees the morning of the Board of Supervisors hearing and just before the action was taken, it is appropriate that the revocation of the permits be rescinded. The draft resolution for revocation of this permit has not been signed by the Chair of the Board.  

SOURCE OF FUNDING

The applicant has been asked to pay the costs associated with preparing this report, which was fairly minimal.

FINANCIAL IMPACT:

There will be no financial impact associated with this action.

STAFFING IMPACT:

This item has been accomplished with existing staff at the Planning and Building Department.

OTHER AGENCY INVOLVEMENT:                     

None

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to rescind the revocation of these Permits.
