RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Receive and file the bid proposals submitted for Storm Damage Repair to Eel Rock Road (7D010) Post Mile 0.50, 0.60, and 1.90;
2. Award the project agreement to Mobley Construction dba MCI for the total amount of $511,993;
3. Authorize the Chair of the Board to execute the project agreement upon submittal of the appropriate bonds and insurance; and
4. Authorize the Public Works Director to execute contract change orders up to the amount of $38,100.

DISCUSSION:
On May 24, 2022, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise Storm Damage Repair to Eel Rock Road (7D010) Post Mile 0.50, 0.60, and 1.90 for bids. On June 28, 2022, the County of Humboldt received three (3) bids for the project, which are attached hereto as Attachment 1.
The Department of Public Works recommends that the Board of Supervisors: receive and file the bid proposals submitted for Storm Damage Repair to Eel Rock Road (7D010) Post Mile 0.50, 0.60, and 1.90; award the attached project agreement to Mobley Construction dba MCI for the total amount of $511,993; authorize the Chair of the Board to execute the attached project agreement upon submittal of the appropriate bonds and insurance; and authorize the Public Works Director to execute contract change orders up to the amount of $38,100.
FINANCIAL IMPACT:
Storm Damage Repair to Eel Rock Road Post (7D010) Mile 0.50, 0.60, and 1.90 is being funded by Federal Emergency Management Agency (FEMA) Disaster Funds (75%), the California Governor’s Office of Emergency Services (18.75%), and the Humboldt County Road Fund (6.25%). The contract bid amount is $511,993. The total project cost is estimated at $640,000. The Humboldt County Road Fund will be responsible for $40,000 of the total costs associated with the Eel Rock Road (7D010) Post Mile 0.50, 0.60, and 1.90 Storm Damage Project.
Expenditure appropriations relating to completion of the Eel Rock Road (7D010) Post Mile 0.50, 0.60, and 1.90 Storm Damage Project are included in the recommended fiscal year 2022-23 budget for the Road Fund budget unit 1200321-2118.
Projects are paid in arrears with anticipated funding coming from FEMA as mentioned above. The FY 2020-21 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $5.9 million. This negative balance is due to the timing of FEMA reimbursements, which can take years for the county to receive repayment. The Department of Public Works utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the 6.25% Humboldt County Road Fund match for FEMA projects. Despite those additional funding sources, Road Fund projects are underfunded and will likely have a negative impact on the General Fund if additional revenue sources are not secured.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board of Supervisors may choose not to award the project agreement for Storm Damage Repair to Eel Rock Road (7D010) Post Mile 0.50, 0.60, and 1.90. However, this alternative is not recommended because the project will restore the roadway to pre-disaster conditions using funds that would not otherwise be available to the County of Humboldt.
