RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the agreement with Humboldt State University Sponsored Programs Foundation for Fiscal Year (FY) 2021-22 to serve as the third-party compliance monitor in connection with the Stipulated Supplemental Judgment entered into between the Attorney General of the State of California and Department of Health and Human Services - Child Welfare Services (DHHS-CWS) in an amount not to exceed $150,000.00;

2.                     Authorize the DHHS-CWS  Director, or a designee thereof, to exercise the option to extend the Agreement for an additional one-year term from July 1, 2022 through June 30, 2022 in an amount not to exceed $150,000.00;

3.                     Approve, and authorize the DHHS-CWS Director, or a designee thereof, to execute any and all amendments to this Agreement after review and approval by County Counsel, Risk Management, and the County Administrative Office;

4.                     Direct the Clerk of the Board to route the fully executed Agreement to the DHHS - Contract Unit for further processing.

DISCUSSION:

On May 28, 2021, the Humboldt County Superior Court approved and entered an Order of Entry of Stipulated Supplemental Judgment as agreed upon between DHHS-CWS and the Attorney General of the State of California. Pursuant to the Judgement, DHHS-CWS is required to obtain the services of a third-party compliance monitor, California Center for Rural Policy (“CCRP”), to review their progress and report to the Attorney General’s Office for the duration of the one-year term of the agreement. The choice of monitor was a collaboration with DHHS-CWS and the Attorney General’s Office.

 

Approval of the agreement with Humboldt State University Sponsored Programs Foundation, on behalf of CCRP, for FY 2021-22 will fulfill the reporting and monitoring requirements set forth in the Stipulated Supplemental Judgment. The Agreement will allow DHHS-CWS to continue to evaluate their progress and take corrective action as needed to fully comply with the terms of the Stipulated Supplemental Judgment.

 

FINANCIAL IMPACT:

The costs associated with the Humboldt State University Sponsored Programs Foundation agreement is $150,000.00, and will reside in Fund 1160, Budget Unit 508, Child Welfare Services. The expenditure related to this agreement was included in the FY 2021-22 approved budget.  Funding for this agreement is a combination of federal, state, and local dollars, with no impact on funding for program purposes. There is no impact to the county general fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the Agreement, which would jeopardize meeting the requirements of a court-ordered Stipulated Supplemental Judgment with the Attorney General of the State of California. This alternative is not recommended.
