RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Adopt the resolution authorizing the Director of the Department of Health and Human Services (DHHS) - Public Health Branch, or a designee thereof, to apply for funding for the next 5 fiscal years (2024-25 through 2028-29) from CalRecycle; and
2. Approve, and authorize the DHHS-Public Health Director, or a designee thereof to enter into and execute grant agreements with CalRecycle for DEH’s LEA program, in Fund 1175, Budget Unit 430 after review of County Counsel and Risk Management; and
3. Authorize the Department of Health and Human Services Director of Public Health or designee thereof to execute all subsequent amendments, and any other agreements, certifications, attestations, and documents directly related to the grant agreements, after review of County Counsel and Risk Management; and
4. Direct the Clerk of the Board to return one certified original, signed copy of the resolution to Public Health Administration.

DISCUSSION:
The Humboldt County Division of Environmental Health’s Local Enforcement Agency program has applied for and has been awarded grant money annually from CalRecycle (formerly California Integrated Waste Management Board) since 1991 to enhance solid waste facility permitting and inspection. The Humboldt County Board of Supervisors previously approved Resolution No. 19-36 on May 14, 2019 (Attachment 2). These grant funds will be incorporated into the LEA Program’s budgets for the next 5 fiscal years. In addition to the Enforcement Assistance grant, LEA received revenue through the Humboldt Waste Management Authority, and City of Fortuna, from solid waste disposal tipping fees as well as permitted facility fees to support the various activities within the program.
The Department of Health and Human Services, Public Health, Division of Environmental Health is requesting the Board give the Public Health Director, or their designee, the authority to apply for this grant funding for fiscal years 2024-25, through 2028-29. Additionally, the resolution will authorize the Director of Public Health, or their designee to execute all applications, agreements, contracts, requests for payment and amendments for securing Enforcement Assistance grants. CalRecycle has requested a multi-year term resolution that is limited to 5 years.

Narrative Explanation of Financial Impact:
Adoption of this resolution will give Public Health the ability to apply for Enforcement Assistance grant funds for the next 5 fiscal years. These funds will be included in the LEA’s budget, fund 1175, budget unit 430, for fiscal years 2024-25 through 2028-29. The grant funds provide an additional $18,000 to $20,000 per year to support salary and training costs for LEA program staff. No matching funds are required.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose to not approve this resolution. This is not recommended, as the loss of funding would result in the full burden of staff time and training costs to fall on revenues collected from tipping and facility fees.
