RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached affiliation agreement with Donor Network West regarding the provision of organ, eye and tissue recovery and donation services at the County of Humboldt’s psychiatric health facility;
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached affiliation agreement with Donor Network West, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one fully executed original copy of the attached affiliation agreement with Donor Network West to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
The County of Humboldt’s psychiatric health facility, Sempervirens, is a 16-bed psychiatric hospital providing around-the-clock inpatient care to individuals requiring psychiatric hospitalization. Sempervirens is operated by the Humboldt County Department of Health and Human Services - Behavioral Health (DHHS - Behavioral Health), and is licensed both as a psychiatric health facility by the California Department of Health Care Services and as an acute psychiatric hospital by the Centers for Medicare and Medicaid Services.
Pursuant to Section 482.45 of Title 42 of the Code of Federal Regulations (C.F.R.), the County of Humboldt must contract with a federally designated organ procurement organization to collaborate regarding the assessment and recovery of organ, tissue and/or eye donations from potential donors at Sempervirens. Donor Network West is the only federally designated organ procurement organization that is qualified to provide organ, tissue and eye donation and recovery services in Humboldt County.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the Chair of the Board to execute, the attached affiliation agreement with Donor Network West regarding the provision of organ, eye and tissue recovery and donation services at the County of Humboldt’s psychiatric health facility. Staff also recommends that the Board authorize the DHHS - Behavioral Health Director to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached affiliation agreement with Donor Network West, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed organ, eye and tissue recovery and donation services at the County of Humboldt’s psychiatric health facility.
FINANCIAL IMPACT:
There are no direct costs associated with the attached affiliation agreement with Donor Network West.
STAFFING IMPACT:
Approval of the attached affiliation agreement with Donor Network West will not impact current staffing levels.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, creating opportunities for improved safety and health and providing community-appropriate levels of service.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached affiliation agreement with Donor Network West regarding the provision of organ, eye and tissue recovery and donation services at the County of Humboldt’s Psychiatric health facility. However, this alternative is not recommended as it will not allow DHHS - Behavioral Health to comply with applicable laws and regulations regarding organ, eye and tissue recovery and donation at publicly operated psychiatric health facilities.
