RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve Standard Agreement No. 22-0200-000-SA, known as the Weighmaster Enforcement Program contract with the California Department of Food and Agriculture-Division of Measurement Standards in the amount of $720.00;
2. Authorize the Chair to sign the original agreement, and direct the Clerk of the Board to return all signed copies to the Agricultural Commissioner’s office for further processing;
3. Grant a waiver from the provisions of the Nuclear Free Ordinance.

California Department of Food Agriculture-Division of Measurement Standards (CDFA-DMS)
DISCUSSION:
The Agricultural Commissioner’s office receives annual subventions from CDFA-DMS to offset the local cost of enforcing certain state-mandated programs. Cooperative Agreement No. 22-0200-000-SA provides funding for Humboldt County’s Weighmaster Enforcement Program activities. DMS will pay Humboldt County $240.00 for each completed initial inspection of an assigned junk dealer or recycler establishment licensed as a weighmaster to determine compliance with Business and Professions Code section 12703.1. An initial inspection is the first physical inspection in the fiscal year of a business location after renewal or issuance of a weighmaster license. The total allocation to the County for these inspections shall not exceed $720.00.
The waiver from the provisions of the Nuclear Free Ordinance is requested since the State of California will not modify its cooperative agreements to accommodate local ordinances.
FINANCIAL IMPACT:
Cooperative Agreement No. 22-0200-000-SA provides $720.00 for the Humboldt County Weighmaster Enforcement Program in FY 2022-23. Payment is made in arrears to Humboldt County based on invoices submitted upon meeting specific contractual requirements. The department’s revenue and expenditure accounts were previously funded in the proposed FY 2022-23 budget.
