RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Ratify the Director of Public Works to sign Contract Change Order Number 3 for the total amount of $55,000;
2. Accept the completed contract, including all change orders approved by the Public Works Department, between Wendell John Gray Construction and Humboldt County for construction of the Redwood House Road (5F200) at Post Mile 7.14 Storm Damage Project; and
3. Approve the final claim for payment, to be submitted by the Public Works Department to the Auditor/Controller, in the amount of $55,000, which will bring the total amount paid to 100% of the contract.

DISCUSSION:
The Federal Emergency Management Agency (FEMA) declared disasters for Humboldt County for the time periods between Feb. 13, 2019, and Feb. 15, 2019, and between Feb. 24, 2019, and March 1, 2019, due to atmospheric rivers that resulted in flooding and mudslides. Redwood House Road (5F200) Post Mile 7.14, located near the community of Carlotta in the central portion of Humboldt County, experienced roadway failures due to a culvert being overwhelmed with high storm water runoff flows in Yager Creek. Emergency temporary repairs were performed at the time of the disaster to maintain essential traffic.
On Sept. 2, 2020, the Humboldt County Department of Public Works (Public Works) received approval from FEMA to proceed with the Redwood House Road (5F200) Post Mile 7.14 Storm Damage Project. Public Works prepared plans and specifications for the project based on a topographic survey of the damaged area prepared by Points West Surveying Company and a geotechnical study prepared by Crawford and Associates. The work consisted of removing the existing drainage facility, constructing an arch culvert on concrete grade beams, placing engineered streambed material and rock slope protection, restoring the road surface to pre-disaster conditions with aggregate base, and installing sediment and erosion control items.
On May 4, 2021, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the Redwood House Road Post Mile 7.14 Storm Damage Project for bids. On June 8, 2021, the County of Humboldt received six (6) bids for the project. The project agreement was awarded to Wendell John Gray Construction, the lowest responsible bidder, on June 29, 2021. The award amount was $457,672, and contract change orders executed during the project increased the authorized amount by $59,815.98. This increase exceeds the authorized contingency by $13,815.98 and is due to costs associated with disposing of unsuitable excavated material and importing structure backfill material to meet the culvert manufacturer’s specifications.
Public Works recommends that the Board of Supervisors ratify the Director of Public Works to sign Contract Change Order Number 3; accept the completed contract, including all change orders approved by Public Works for this project; and approve the final claim for payment.
FINANCIAL IMPACT:
Total construction costs for the Redwood House Road (5F200) Post Mile 7.14 Storm Damage Project are $517,487.98. Progress payments totaling $462,487.98 have been paid, and the final claim for payment in the amount of $55,000 is outstanding.
This project was funded through Federal Emergency Management Agency Disaster Funds (75%), the California Governor’s Office of Emergency Services (18.75%), and the Humboldt County Road Fund (6.25%). Expenditure appropriations relating to completion of the Redwood House Road (5F200) Post Mile 7.14 Storm Damage Project are included in the fiscal year 2021-22 Road Fund (1200). Therefore, the Redwood House Road Post Mile 7.14 Storm Damage Project will not impact the Humboldt County General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board of Supervisors may choose not to accept the project. However, staff does not recommend this alternative because the project has been completed, and the requested Board actions are needed to accept the contract.
