RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Purchasing Agent, or a designee thereof, to execute, Change Order 2 for the Humboldt County Courthouse Fourth Street Americans with Disabilities Act Project, Project Number 2020-101, in the amount of Thirty-Seven Thousand Seven Hundred Forty-Five Dollars ($37,745.00);
2. Approve the Supplemental Budget for Fiscal Year 2024-25 for Change Order 2 for the Humboldt County Courthouse Fourth Street Americans with Disabilities Act Project, Project Number 2020-101, in the amount of Thirty-Seven Thousand Seven Hundred Forty-Five Dollars ($37,745.00) (4/5 Vote Required); and
3. Direct the Clerk of the Board to provide the County Administrative Office with one (1) fully executed, certified copy of the Board Order related to this item.

DISCUSSION:
On September 7, 2016, the County of Humboldt entered into a Consent Decree with the United States Department of Justice that required the commencement of the Humboldt County Americans with Disabilities Act (“ADA”) Compliance Project. The purpose of the Humboldt County ADA Compliance Project is to bring all facilities owned and/or leased by the County of Humboldt that provide programs, services and activities to the public into compliance with the ADA. The Humboldt County Courthouse Fourth Street ADA Modification Project is part of this compliance effort.
On May 16, 2023, the Humboldt County Board of Supervisors (“Board”) awarded the Humboldt County Fourth Street ADA Modification Project to Adams Commercial General Contracting, Inc. for the base bid amount of Five Hundred Fourteen Thousand Sixty-Eight Dollars ($514,068.00). This project replaced the accessible parking stall in the Fourth Street parking lot adjacent to the building with an ADA compliant van accessible stall, replaced the aging moisture barrier located between the parking lot asphalt and the ceiling of the Office of Emergency Services located directly below. The project replaced the accessible route linking the building entrance to the public right of way on the Fourth Street side of the courthouse as well as replaced the problematic outward swinging entrance and exit doors located in the Fourth Street security vestibule with electronic sliding doors similar to the ones used on the Fifth Street side of the facility. Decorative security retaining wall type bollards designed to prevent vehicles from driving into the security vestibule were installed around the newly constructed accessible route and Fourth Street parking lot. This project included painting and flooring replacement on the ground floor hall between the security vestibule and the Sheriff’s Office lobby.
On October 24, 2023, the Board approved Change Order 1 in the amount of One Hundred Thirty-Five Thousand Three Hundred Eight Dollars ($135,308.00) which included additional removal and replacement of the moisture barrier and additional sidewalk work in the Cal-Trans right of way.
Upon installation of the new flooring in the ground floor corridor and security vestibule, the County Administrative Office began to receive complaints from building occupants about the new floor with claims that the design was causing dizziness as individuals navigated the corridor and security vestibule. Staff requested a quote from the contractor to replace the flooring with a style with more of a subdued design. Before your Board today is Change Order 2 in the amount Thirty-Seven Thousand Seven Hundred Forty-Five Dollars ($37,745.00) for the flooring replacement and drywall repairs resulting from a roof leak in the half dome ceiling and supplemental budget related thereto.

The attached supplemental budget will increase the fixed asset line 8967-Courthouse Modifications in the ADA Compliance budget unit 3552-152 for the Courthouse Fourth Street modification project in the amount of Thirty-Seven Thousand Seven Hundred Forty-Five Dollars ($37,745.00). The project was not anticipated to continue into FY 2024-25, so no appropriations were included in the adopted budget. The increased construction costs will be funded through a combination of the Amended 2020 Finance Plan in the amount of Twenty-Four Thousand Four Hundred Forty-Three Dollars ($24,443.00), Deferred Maintenance in the amount Eight Hundred Thirty-Nine Dollars ($839.00) and the court cost share in the amount of Twelve Thousand Four Hundred Sixty-Three Dollars ($12,463.00). Total project costs including Change Order 1 and 2 is estimated to be Eight Hundred Thirteen Thousand Two Hundred Eighty-Five Dollars ($813,285.00).
STAFFING IMPACT:
The recommended actions will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the recommendation to approve Change Order 2 for the Humboldt County Courthouse Fourth Street ADA Project. However, this alternative is not recommended as complaints have been received citing the existing flooring is causing dizziness and drywall repairs are necessary as a result of roof leaks.
