Recommendation
That the Board of Supervisors:
1. Approve and authorize the Chair to execute the attached Health Officer Agreement Second Amendment with Candy Stockton-Joreteg for period of July 1, 2024, to June 30, 2027.

DISCUSSION:
Pursuant to Health and Safety Code section 101000 and Government Code section 24000, subdivision(s), counties are required to maintain a Health Officer. The Health Officer is required to enforce and observe 1) Board orders and ordinances pertaining to public health matters, quarantines and regulations; 2) orders, including quarantine and other regulations prescribed by the California Department of Public Health; and 3) statutes relating to public health. The Health Officer is further required to implement measures to prevent the spread of communicable diseases such as tuberculosis, or other widespread communicable diseases.
On April 15, 2022 in Closed Session (Item C-4), your Board selected Dr. Candy Stockton-Joreteg, to be designated and employed by the County as the new Humboldt County Health Officer.
On May 24, 2022 at the regular meeting (Item D-19), your Board approved the execution of the Agreement with Dr. Candy Stockton-Joreteg as the Humboldt County Health Officer.
On April 4, 2023 at the regular meeting (Item D-23), your Board approved the First Amendment of the Agreement with Candy Stockton-Joreteg as the Humboldt County Health Officer, amending the term and updating the compensation rate aligned with the County compensation rate changes.
This Agreement Amendment before your Board today authorizes DHHS to maintain Dr. Stockton- Joreteg’s services as Humboldt County’s Health Officer through June 30, 2027.

Narrative Explanation of Financial Impact:
The Health Officer position is included in Public Health Fund 1175, Administration Budget Unit 400. The full-time equivalent (FTE) of the position, per this amendment to the agreement, is 0.75 FTE, and the salary, as specified in Exhibit B of the attached agreement, is $109.91 per hour. The agreement provides that the Health Officer’s salary amount has accounted for scheduled pay increases for Fiscal Year (FY) 2024-2025, 2025-2026, and 2026-2027. This amendment to the agreement before your Board today authorizes DHHS to maintain Dr. Stockton-Joreteg’s services as Humboldt County’s Health Officer effective July 18, 2022 through June 30, 2027. The Annual cost of the Health Officer position in FY 2024-2025, including benefits, will be approximately $273,718 at 0.75 FTE. Additional costs for this agreement include membership costs estimated to be $375 for FY 2024-2025, 2025-2026, and 2026-2027. The Fiscal Year 2024-2025 annual salary and associated costs for the agreement before your Board today was included in the FY 2024-2025 proposed County budget, and future annual salary and associated costs will be included in the FY 2025-2026 and FY 2026-2027 proposed County Budgets.
This amendment also includes a provision for a cash settlement in the event the contract terminates prior to the end of the contract. Additionally, mandatory language from the Government Code regarding cash settlements has been included in the amendment.
STAFFING IMPACT:
This position is pursuant to Health and Safety Code section 101000 and Government Code section 24000, subdivision(s), counties are required to maintain a Health Officer. Per Code the Board of Supervisors is required to make the appointment. Without a Health Officer, Public Health would not be able to continue to apply for grants or be eligible to State and Federal funds.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board may choose to not approve the agreement amendment, however, this is not recommended as the County is required to maintain a Health Officer pursuant to Health and Safety Code 101000 and Government Code Section 24000, subdivision(s).
