RECOMMENDATION(S):

Recommendation

That the Zoning Administrator:

1.                     Adopt the resolutions, (Attachments 2-32) which does the following:

 

a.                     Finds that the cannabis permit application projects are statutorily exempt from the California Environmental Quality Act (CEQA) per section 15270 (Projects Which Are Disapproved) of the State CEQA Guidelines; and

 

b.                     Finds that the applicant has not provided sufficient evidence to demonstrate the proposed projects comply with the General Plan and Zoning Ordinance; and

DISCUSSION:

Environmental Review: The proposed projects are statutorily exempt from the provisions of the California Environmental Quality Act (CEQA) per section 15270 (Projects Which Are Disapproved) of the CEQA Guidelines.

 

State Appeal: These projects are NOT appealable to the California Coastal Commission

 

Major Concerns: Inconsistency with Humboldt County Code, lack of adequate information to support making required findings for approval, and a generally unresponsive applicant.

 

Executive Summary: For Zoning Administrator consideration are thirty-one applications, Seventeen (17) Conditional Use Permits, Eleven (11) Special Permits, One (1) Zoning Clearance Certificate and Two (2) Modification Permits, under the Commercial Medical Marijuana Land Use Ordinance (CMMLUO) described below:

 

1.                     PLN-10453-CUP, H.C.C.C., APN 210-042-018-000: Denial of a Conditional Use Permit (CUP16-321) for 17,200 square feet (SF) existing medical cannabis cultivation area consisting of 9,100 SF outdoor and 8,100 SF mixed-light.

 

2.                     PLN-10925-CUP, Nocturnal Farms Collective, APN 221-181-025-000: Denial of a Conditional Use Permit for an existing 32,737 square feet of outdoor medical cannabis cultivation operation.  

 

3.                     PLN-11110-CUP, Iaqua Estates, LLC, APN 314-224-004-000: Denial of a Conditional Use Permit for existing 22,000 sf mixed light medical commercial cannabis cultivation. 

 

4.                     PLN-11228-SP, Humboldt Gold, LLC, APN 516-311-049-000: Denial of a Special Permit for new 500 square foot indoor cannabis cultivation operation. 

 

5.                     PLN-11288-CUP, Soaring Sun Farms, APN 317-052-003-000: Denial of a Conditional Use Permit for 19,000 square feet of existing, outdoor, medical cannabis cultivation.

28.                     PLN-2019-15501, WE Investment Properties, LLC, APN 506-231-012-000, 506-131-015: Denial of a Conditional Use Permit for 130,680 square feet of new indoor commercial cannabis cultivation and a 30,000 square-foot commercial cannabis nursery.

 

29.                     PLN-2019-15566, 130 Willow Creek OpCo, LLC, APN 522-201-001-000: Denial of a Modification to an approved Conditional Use Permit (PLN-10406-CUP) to modify the phases and proposes a new design to adjust the location, size and design of infrastructure related to the cultivation, water storage, and related operations. 

 

30.                     PLN-2019-16088, Matthew Penner, APN 522-051-003-000: Denial of a Zoning Clearance Certificate for 5,200 square feet of existing outdoor commercial cannabis cultivation and a Special Permit to reduce the 600-foot setback to public lands.

 

31.                     PLN-2020-16611, 4th Generation Farms Humboldt, APN 209-321-007-000: Denial of a Modification to Special Permit (10424) to add 30' x 75' ancillary nursery, roughly 40' x40' metal building for processing, materials storage and propagation, convert outdoor to mixed light, add RV/trailer for security.

 

All of these applications have been in process for an extended period of time, well over 4 years in every case, and have received correspondence from the Planning and Building Department identifying application deficiencies which prevent the Department from completing a review for consistency with the General Plan and County Code. On November 18, 2025, a final letter was sent to all of these applicants which provided two options, to submit a withdrawal request in writing, or provide the items requested by the County in previous communications. The letter further stated that a response was required within 30 days, and if a response was not received, the Planning Department would schedule the application for hearing with a recommendation of denial. To date, a request for withdrawal and/or none of the requested materials have been received by any of these applications.

 

The project history and project files associated with these permit applications demonstrate a lack of information required to determine consistency with the CMMLUO and a lack of responsiveness from the applicant. 

 

OTHER AGENCY INVOLVEMENT:                     

Any referrals that may be associated with one or more of these projects are irrelevant, due to the recommendation of denial for lack of information and/or responsiveness.

 

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

1.                     The Zoning Administrator could elect to direct staff to continue to work with the applicants to resolve the outstanding issues and continue processing the applications in accordance with HCC Section 312-4.1 et seq. However, due to the extended amount of time that deficiencies have remained unresolved and the lack of responsiveness from the applicant, staff does not recommend this alternative.
