RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Receive and file the bids for construction of the Clark Complex Americans with Disabilities Act Modification Project;

2.                     Award the project agreement to the lowest responsible and responsive bidder, Adams Commercial General Contracting, Inc. in the amount of Three Hundred Forty-Six Thousand Twelve Dollars ($346,012.00);

3.                     Authorize the Purchasing Agent to sign a project agreement with Adams Commercial General Contracting, Inc., that is substantially similar to the sample agreement attached hereto after review and approval by County Counsel, Risk Management and the County Administrative Office; and

4.                     Authorize the Purchasing Agent to execute contract change orders up to the amount of Thirty-Four Thousand Six Hundred One Dollars ($34,601.00).

DISCUSSION:

On September 7, 2016, the County of Humboldt entered into a Consent Decree with the United States Department of Justice that required the commencement of the Humboldt County Americans with Disabilities Act Compliance Project. The purpose of the Humboldt County Americans with Disabilities Act Compliance Project is to bring all county-owned and leased facilities that provide programs, services and activities to the public into compliance with the Americans with Disabilities Act (“ADA”).  The Clark Complex Americans with Disabilities Act Modification Project is part of this compliance effort.

 

On August 13, 2020, the County of Humboldt entered into a consultant services agreement with Brokaw Design to design ADA improvements at the Clark Complex.  The Clark Complex Americans with Disabilities Act Modification Project will  remove barriers to access in the multi-user men’s and woman’s restrooms on the first floor, provide a facelift in the staff restroom behind the service counter, improve the accessible route to the main lobby by installing a wheelchair lift and reconstruct a portion of the parking lot with one (1) ADA accessible van parking stall.  Staff worked with Public Works, Planning and Building and Brokaw Design in the review and development of the project’s plans, specifications and timeline.

 

On November 8, 2022, the Humboldt County Board of Supervisors (“Board”) authorized the Clark Complex Americans with Disabilities Act Modification Project to be advertised for public bid.  On December 6, 2022, the County of Humboldt received and opened two (2) responsive bids and the results are as follows:

The general conditions set forth in the project specifications manual require that the project be awarded on the merits of the lowest qualified, responsible and responsive base bid.  Staff recommends that your Board award this project to Adams Commercial General Contracting, Inc. - Eureka, California for the total base bid award amount of Three Hundred Forty-Six Thousand Twelve Dollars ($346,012.00). 

 

FINANCIAL IMPACT:

Current project expenses combined with the base bid amount of Three Hundred Forty-Six Thousand Twelve Dollars ($346,012.00), establishes an estimated project cost of Four Hundred Fifteen Thousand One Hundred Twenty-Eight Dollars ($415,128.00).  The ADA Compliance Team has funds in the amount of Three Hundred Eighteen Thousand Three Hundred Seventeen Dollars ($318,317.00) available for the Clark Complex Americans with Disabilities Act Modification Project.  Planning and Building has committed additional funds needed in the amount of Ninety-Six Thousand Eight Hundred Eleven Dollars ($96,811.00) in budget unit 1100-277.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by fostering transparent, accessible welcoming and user friendly services and providing for and maintaining infrastructure.

 

OTHER AGENCY INVOLVEMENT:                     

None

 

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to award the project agreement for the Clark Complex Americans with Disabilities Act Modification Project.  However, this alternative is not recommended as the County of Humboldt may be subject to fines for non-compliance, as the Clark Complex is a facility identified by the Department of Justice with ADA barriers that must be removed.
