RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Authorize the Director of Public Works Director, the Deputy Director of Public Works- Engineering, the Sheriff, and the Director of Public Health to act as agents of the County of Humboldt for purposes of obtaining certain federal financial assistance under any and all applicable local, state and federal laws and regulations;

2.                     Authorize the above-referenced officials to execute, and provide the California State Office of Emergency Services (CalOES) and the Federal Emergency Management Agency (FEMA) with, and all required assurances and agreements for all matters pertaining to such state disaster assistance;

3.                     Authorize the Department of Public Works to file the attached California State of Office of Emergency Services Form 130- Designation of Applicant’s Agent Resolution for Non-State Agencies with the California Office of Emergency Services;

4.                     Authorize the Clerk of the Board to sign the California Office of Emergency Services Form 130- Designation of Applicant’s Agent Resolution for Non-State Agencies; and

5.                     Direct the Clerk of the Board to return a fully executed original copy of the attached California Office of Emergency Services Form 130- Designation of Applicant’s Agent Resolution for Non-State Agencies for further processing.

DISCUSSION:

For the County of Humboldt to request reimbursement of costs incurred in state and federally declared disasters, California Office of Emergency Services (CalOES) and the Federal Emergency Management Agency (FEMA) require that the Humboldt County Board of Supervisors officially designate specific people to act as agents of the county. CalOES and FEMA also require that such agents be authorized to sign any and all documents necessary to ensure that the reimbursement process from FEMA and CalOES can proceed on any given disaster related repair project.

 

The County of Humboldt periodically endures declared disasters which require the repair of county facilities and infrastructure due to damage from earthquakes, floods, and other natural phenomena. With new disaster declarations a new CalOES Form 130- Designation of Applicant’s Agent Resolution for Non-State Agencies must be filed with CalOES to update the list of personnel authorized to act on behalf of the County.

 

In June 2017, the Department of Public Works filed a CalOES Form 130 with the CalOES after FEMA declared two disasters related to severe winter storms, flooding, and mudslides in February of 2017.

 

In 2019, FEMA declared another new disaster due to an atmospheric river which resulted in flooding and mudslides. No new CalOES Form 130 was submitted at that time because this new declaration was within the three-year allotted window for the universal resolution approved and filed in 2017.

 

In April 2020, the Department of Public Health submitted a new CalOES Form 130 after FEMA declared a new disaster related to the COVID-19 pandemic. This CalOES Form 130 form was submitted as a universal resolution rather than a disaster specific resolution, which removed Public Works from the list of officially designate agents of the county.

 

The attached CalOES Form 130 before your Board today return the Public Works Director and the Public Works Deputy Director- Engineering to the list of authorized agents for the County of Humboldt and will be used for all currently open disasters, and any new disasters declared within the next three years.

 

In the future the attached CalOES Form 130 will need to be updated, as necessary, to reflect changes in authorized personnel. A list of individuals currently serving in these positions will accompany the fully executed CalOES Form 130 that is filed with CalOES.

 

 

FINANCIAL IMPACT:

Approval of the attached CalOES Form 130 will allow Public Works, Sheriff, and Public Health to continue to request reimbursement from FEMA and CalOES for expenses incurred due to the multiple active FEMA disaster projects.

 

STRATEGIC FRAMEWORK:

This action supports your Board’s Strategic Framework by providing for and maintaining infrastructure and creating opportunities for improved safety and health.

The California State Office of Emergency Services and the Federal Emergency Management Agency.

 

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to authorize the Department of Public Works to file the attached CalOES Form 130 with CalOES. This alternative is not recommended since it would preclude the county from seeking reimbursement for efforts related to a declared disaster.
