RECOMMENDATION(S):Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute the attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022 regarding the provision of pharmaceutical consultation services in an amount not to exceed Ninety-Two Thousand Eighty-Eight Dollars ($92,088.00) for the period of July 1, 2022 through June 30, 2028; and

2.                     Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022, after review and approval by County Counsel, Risk Management and the County Administrative Office; and

3.                     Direct the Cler of the Board to electronically provide the Department of Health and Human Services - Contract Unit with one (1) fully executed certified copy of the Board Order related to this item.

DISCUSSION:

Pursuant to Section 77079.2 of Title 22 of the California Code of Regulations and Section 482.25 of Title 42 of the Code of Federal Regulations the County of Humboldt’s psychiatric health facility is required to procure various pharmaceutical consultation services from a registered pharmacist to ensure competent coordination, supervision and review of the medication services being provided therein.

 

On Nov. 23, 2022, the County of Humboldt, by and through its Department of Health and Human Services - Behavioral Health (DHHS - Behavioral Health), entered into a professional services agreement with Eureka Pharmacy, LLC, doing business as Cloney’s Long Term Care Pharmacy, regarding the provision of on-site pharmaceutical consultation services at the County of Humboldt’s psychiatric health facility, and other DHHS - Behavioral Health facilities, including, without limitation, the Crisis Stabilization Unit and Medication Support Clinics, for the period of July 1, 2022 through June 30, 2024.  The professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022, was subsequently amended in order to extend the term thereof and increase the maximum amount payable thereunder on May 14, 2024. 

 

The attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022, will allow for the continued provision of required pharmaceutical consultation services at the County of Humboldt’s psychiatric health facility, and other DHHS - Behavioral Health facilities, for the period of July 1, 2022 through June 30, 2028.

 

Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute the attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022, regarding the provision of pharmaceutical consultation services for the period of July 1, 2022, through June 30, 2028. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of mandated pharmaceutical consultation services at the County of Humboldt’s psychiatric health facility and other DHHS - Behavioral Health facilities.

The attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated Nov.23, 2022 will increase maximum amount payable thereunder from Fifty-Two Thousand Dollars ($52,000.00) for the period of July 1, 2022 through June 30, 2026 to Ninety-Two Thousand Eighty-Eight Dollars ($92,088.00) for the period of July 1, 2022 through June 30, 2028.  In no event shall the maximum amount paid under the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022 exceed Seven Thousand Dollars ($7,000.00) for fiscal year 2022-2023, Fifteen Thousand Dollars ($15,000.00) for fiscal year 2023-2024, Nineteen Thousand Eighty-Eight Dollars ($19,088.00) for fiscal year 2024-2025 and Seventeen Thousand Dollars ($17,000.00) per fiscal year for fiscal years 2025-2026 through 2027-2028.  However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022 in its entirety.

 

Expenditure appropriations related to the attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022 have been included in the approved fiscal year 2025-2026 budgets for DHHS - Behavioral Health budget units 1170-495 and 1170-498.  Funding for the attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022 is available through Medicaid federal financial participation and state realignment and Mental Health Services Act revenues received by DHHS - Behavioral Health.

 

STAFFING IMPACT:

Approval of the attached second amendment to the pharmaceutical consultation services agreement with Eureka Pharmacy, LLC dated Nov. 23, 2022, will not impact current staffing levels.

 

OTHER AGENCY INVOLVEMENT:

None

 

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to approve the attached second amendment to the professional services agreement with Eureka Pharmacy, LLC dated November 23, 2022, regarding the provision of pharmaceutical consultation services.  However, this alternative is not recommended since it will not allow DHHS - Behavioral Health to receive required pharmaceutical consultation services in accordance with applicable local, state and federal laws, regulations, policies, procedures and standards.
