Recommendation
That the Board of Supervisors:
1. Receive and file the bid proposals submitted for the Humboldt Bay Trail South Project;
2. Award the project agreement to McCullough Construction, Inc., for the total amount of $12,983,350.96; and
3. Authorize the Chair of the Board to execute the project agreement upon submittal of the appropriate bonds and insurance; and
4. Authorize the Public Works Director to execute contract change orders up to the amount of $210,000.

DISCUSSION:
On Jan. 24, 2023, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the Humboldt Bay Trail South Project for bids. On March 14, 2023, the County of Humboldt received three (3) bids for the project, which are attached hereto as Attachment 1.
The Department of Public Works recommends that the Board of Supervisors: receive and file the bid proposals submitted for the Humboldt Bay Trail South Project; award the attached project agreement to McCullough Construction, Inc., for the total amount of $12,983,350.96; authorize the Chair of the Board to execute the attached project agreement upon submittal of the appropriate bonds and insurance; and authorize the Public Works Director to execute contract change orders up to the amount of $210,000.

Narrative Explanation of Financial Impact:
Construction of the Humboldt Bay Trail South Project is being funded by the California Transportation Commission’s Active Transportation Program (up to $13,300,000), the California Department of Transportation’s Minor B Program (up to $1,250,000), and the California Coastal Conservancy (up to $1,900,000). The total available funding from these sources is $16,450,000, and the total project cost for construction and construction engineering is estimated at $16,296,000. Therefore, the County of Humboldt will not be responsible for any of the costs associated with constructing the Humboldt Bay Trail South Project.
Expenditure appropriations relating to completion of the Humboldt Bay Trail South Project are included in the approved fiscal year 2022-23 budget at revenue line 1710715-523190 and expenditure line 1710715-8946, and will be included in the proposed budget submittals for fiscal years 2023-24 and 2024-25. This is a reimbursement project and expenditures must be realized before any funds can be recouped. Fund 1710- Forest Resources and Recreation does not currently have dedicated revenue sources to support having cash on hand for initial project related expenditures prior to reimbursement so there is limited liability to the General Fund until reimbursement is received.
In future years development of the McKay Community Forest, currently under development, should generate stable revenue for the Forest Resources and Recreation Fund to mitigate that initial liability to the General Fund. Funding sources for this Humboldt Bay Trail South Project can be billed at minimum quarterly, or more often as needed when larger expenditures occur to manage cash flow coming back to the fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board of Supervisors may choose not to award the project agreement for the Humboldt Bay Trail South Project. However, this alternative is not recommended because the project will construct the final segment of the Humboldt Bay Trail, a regional priority for over 20 years, using funds that would not otherwise be available to Humboldt County.
