RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve the attached Local Interagency Agreement by and between the County of Humboldt and Humboldt County Office of Education; and
2. Authorize the Department of Health and Human Services - Public Health Director, or a designee thereof, to execute the attached Local Interagency Agreement by and between County of Humboldt and Humboldt County Office of Education; and
3. Authorize the Department of Health and Human Services - Public Health Director, or a designee thereof, to execute any and all subsequent amendments, certifications, attestations, and documents directly associated to the attached Local Interagency Agreement by and between County of Humboldt and Humboldt County Office of Education after review and approval by County Counsel, Risk Management and the County Administrative Office.

DISCUSSION:
The County of Humboldt Department of Health and Human Services - Public Health Branch (“DHHS - PHB”) Nursing Division has been administering the California Children’s Services (“CCS”) program locally since 1980. CCS is a mandated statewide program that authorizes diagnosis and treatment services and provides medical case management. In addition, CCS provides specialty pediatric physical and occupational therapy through the Medical Therapy Program (“MTP”) for medically eligible physical conditions and authorizes the purchase of specific medical services and equipment. The MTP is housed at the Medical Therapy Unit (“MTU”) at the Glen Paul School under the authority of the Humboldt County CCS Program. Glen Paul School programs are designed to meet the special education needs of children and youth from birth to age 21.
The Crown Act of 1968 established county responsibility for administering the Medical Therapy Programs locally in public school settings. In 1998 the California Code of Regulations Title 2, § 60310 specifies the requirement for the administrator of the local CCS Program and local Office of Education to develop an interagency agreement to clarify fiscal responsibility for children with special medical needs.
The respective Local Interagency Agreement for the Humboldt area is before you today. On August 17, 1999 (Item C-35) the Board approved the Interagency Agreement between the California Children Services Program and the Humboldt County Office of Education. On November 8, 2012 (Item C-13) the Board approved the Interagency Agreement between the County of Humboldt, Department of Health and Human Services, and the Humboldt County Office of Education for the California Children’s Services Medical Therapy Program. The current agreement details requirements in state and federal law, including the identification of a liaison between the involved agencies, required referrals between the agencies; exchange of information, improved interagency notification procedures; Individual Education Plan (IEP) participation and procedures for each child; responsibility for transportation to and from the MTU; MTP facility needs and who is responsible for providing them; plans for mutually beneficial staff development; local conflict resolution; and annual review of the interagency agreement.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to sign this agreement. However, this is not recommended as CCS MTU is a mandated state program and the agreement is required by the Integrated Systems of Care Division of the California Department of Health Care Services.
