RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Adopt the resolution (Attachment 1) which does the following:

a.                     Rescinds the action taken on May 12, 2026, to revoke the Conditional Use Permit granted for PLN-12049-CUP.

DISCUSSION:

Executive Summary

This item requests the Board of Supervisors rescind the revocation action that was taken on May 12, 2026, for the Conditional Use Permit for PACWI, LLC, Permit Number PLN-12049-CUP. The permit was one of 36 that the Board voted to revoke due to a failure to pay Measure S taxes.

Shortly after the action on May 12 was taken by the Board, the permit holder reached out to the county and stated that they had not received proper notice of the proposed revocation and paid the taxes that were owed. County records show that a notice of permit suspension was sent to an address in January, 2026 that was different than the address where the certified notice of potential revocation was sent. Although staff verified that the address where the certified notice of revocation was sent was accurate and that the permit holder had recently updated their contact information with the Planning & Building Department, there remains some question as to what the appropriate address for the permit holder was in January of 2026 as the permit holder states that they have moved and lived in different places recently.

As there are remaining questions about whether the permit holder was properly notified of the suspension in January 2026 and the past due taxes were resolved immediately upon contacting the Planning & Building Department, staff believe it is appropriate that the revocation of the permit should be rescinded. The draft resolution for revocation of this permit was never signed by the Chair of the Board.  

SOURCE OF FUNDING

There is no identified funding source for this action. This is funded by the General Fund Contribution to department operations.

FINANCIAL IMPACT:

There are no funds that have been identified to cover the costs of processing this revocation.

STAFFING IMPACT:

This item has been accomplished with existing staff at the Planning and Building Department and the Treasurer-Tax Collector.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to rescind the revocation of this permit.
