RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Receive and file the bid proposals submitted for Storm Damage Repair to Mattole Road (Bull Creek) (F3D010) at Post Miles 13.66-13.68 and 16.15;

2.                     Award the project agreement to G.R. Wilcox Enterprises, Inc., for the total amount of $1,061,150.69;

3.                     Authorize the Chair of the Board to execute the project agreement with G.R. Wilcox Enterprises, Inc., upon submittal of the appropriate bonds and insurance; and

4.                     Authorize the Public Works Director to execute contract change orders up to the amounts of $49,026 for Post Miles 13.66-13.68 and $29,031 for Post Mile 16.15.

DISCUSSION:

On April 9, 2024, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise Storm Damage Repair to Mattole Road (Bull Creek) (F3D010) at Post Miles 13.66-13.68 and 16.15 for bids. On May 14, 2024, the County of Humboldt received five bids for the project, which are attached hereto as Attachment 1. On reviewing the bid forms, Department of Public Works observed a minor computational error on G.R. Wilcox Enterprises, Inc.’s bid form. This error has been corrected in the attached construction agreement.

 

The Department of Public Works recommends that the Board of Supervisors receive and file the bid proposals submitted for Storm Damage Repair to Mattole Road (Bull Creek) (F3D010) at Post Miles 13.66-13.68 and 16.15; award the attached project agreement to G.R. Wilcox Enterprises, Inc., for the total amount of $1,061,150.69; authorize the Chair of the Board to execute the attached project agreement with G.R. Wilcox Enterprises, Inc., upon submittal of the appropriate bonds and insurance; and authorize the Public Works Director to execute contract change orders up to the amounts of $49,026.00 for Post Miles 13.66-13.68 and $29,031.00 for Post Mile 16.15.

Narrative Explanation of Financial Impact:

The Mattole Road (F3D010) Post Miles 13.66-13.68 and 16.15 Storm Damage Repair Project is being funded by Federal Highway Administration Emergency Relief Funds (88.53%) and the Humboldt County Road Fund (11.47%). The total project cost is estimated at $1,326,439, as shown in Attachment 1. The Humboldt County Road Fund will be responsible for $152,142.55 of the total costs associated with the Mattole Road (F3D010) Post Miles 13.66-13.68 and 16.15 Storm Damage Repair Project. Expenditure appropriations relating to completion of the Mattole Road (F3D010) Post Miles 13.66-13.68 and 16.15 Storm Damage Repair Project are included in the proposed fiscal year (FY) 2024-25 Road Fund Budget (1200321-8940).

 

Projects are paid in arrears with anticipated funding coming from the Federal Highway Administration as mentioned above. The FY 2022-23 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $8.4 million in the county’s Road Fund. Even after allocating nearly $6.8 million of American Rescue Plan Act (ARPA) funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately $7.7 million.

 

This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment. The current total of outstanding repayments is approximately $11.4 million. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects. Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

Awarding the project agreement for the Mattole Road (F3D010) Post Miles 13.66-13.68 and 16.15 Storm Damage Repair Project will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board of Supervisors may choose not to award the project agreement for Storm Damage Repair to Mattole Road (Bull Creek) (F3D010) at Post Mile 13.66-13.68 and 16.15. However, this alternative is not recommended because the project will restore the roadway to pre-disaster conditions using funds that would not otherwise be available to the County of Humboldt.
