RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Accept the completed contract, including all change orders approved by the Public Works Department, between Wahlund Construction, Inc., and Humboldt County for construction of Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70; and

2.                     Approve the final claim for payment, to be submitted by the Public Works Department to the Auditor-Controller, in the amount of $185.00, which will bring the total amount paid to 100% of the contract.

DISCUSSION:

On Jan. 12, 2006, the Governor of the State of California declared a disaster for Humboldt County due to severe winter storms, flooding, and mudslides. Alderpoint Road (F6B165) Post Miles 40.21 to 40.70, near the town of Bridgeville in the eastern portion of Humboldt County, experienced roadway settlement and shoulder failure. Emergency temporary repairs were performed at the time of the disaster to maintain essential traffic.

 

On Feb. 15, 2018, the Humboldt County Department of Public Works (Public Works) received Federal Highway Administration funding approval to proceed with Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70. Public Works prepared plans and specifications for the project based on a topographic survey of the damaged area prepared by Points West Surveying Company and a geotechnical study prepared by Crawford and Associates. The work consisted of reconstructing the roadway embankment and roadbed with geosynthetic material, installing sub-surface and surface drainage systems, restoring the roadway to original width, and installing erosion control items.

 

On June 22, 2021, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70 for bids. On July 27, 2021, the County of Humboldt received five bids for the project. On Aug. 17, 2021, the Humboldt County Board of Supervisors awarded the project agreement to Wahlund Construction, Inc., the lowest responsive bidder. The award amount was $1,417,513.90, and contract change orders executed during the project increased the authorized amount by $137,386.19. Contract Change Order Number 2 relates to relocation of an underground communication cable and will be paid by AT&T.

 

Public Works recommends that the Board of Supervisors accept the completed contract, including all change orders approved by Public Works for this project, and approve the final claim for payment.

Narrative Explanation of Financial Impact:

Total construction costs for Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70 are $1,554,900.09. Progress payments totaling $1,554,715.09 have been paid, and the final claim for payment in the amount of $185 is outstanding.

 

Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70 is funded by Federal Highway Administration (FHWA) Emergency Relief Funds (88.53%), AT&T ($7,772.10), and the Humboldt County Road Fund (11.47%). Expenditure appropriations relating to completion of Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70 are included in the approved fiscal year (FY) 2023-24 Road Fund Budget (1200321-8940). The amount shown in the Financial Impact Table above ($185,280.48) includes the pending final claim in the amount of $185.00, Progress Payment Number 10 in the amount of $137,641.48, and Progress Payment Number 11 in the amount of $47,454.00. 

Projects are paid in arrears with anticipated funding coming from FHWA as mentioned above. The FY 2022-23 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $8.4 million in the county's Road Fund. Even after allocating nearly $6.8 million of American Rescue Plan Act (ARPA) funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately $7.7 million.

 

This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment. The current total of outstanding repayments is approximately $11.4 million. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects. Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

Accepting Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70 will not impact current staffing levels.

The Board of Supervisors may choose not to accept Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 40.21 to 40.70. However, this alternative is not recommended because this project has been completed, and the requested Board actions are needed to accept the contract.
