RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Waive the requirements of the Humboldt County Nuclear-Free Ordinance with regard to the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority;
2. Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or designee thereof, to execute, the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities for the period of October 1, 2023 through June 30, 2025;
3. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority after review and approval by County Counsel, Risk Management and the County Administrative Office; and
4. Direct the Clerk of the Board to provide the Department of Health and Human Services - Contract Unit with one (1) fully executed certified copy of the Board Order relating to this item.

DISCUSSION:
Pursuant to California Welfare and Institution Code Sections 4330, et seq., the California Mental Health Services Authority contracts with the California Department of State Hospitals regarding the use of state hospital facilities on behalf of counties participating in the State Hospitals Program. The attached memorandum of understanding with California Department of State Hospitals and the California Mental Health Services Authority will allow the Humboldt County Department of Health and Human Services - Behavioral Health (“DHHS - Behavioral Health”) to place Humboldt County clients who require twenty-four (24) hour supervision at any of the five (5) state hospitals, when no other facilities are available, for the period of October 1, 2023 through June 30, 2025. It should be noted that the attached memorandum of understanding with California Department of State Hospitals and the California Mental Health Services Authority comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract development process.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities for the period of October 1, 2023 through June 30, 2025. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the placement of Humboldt County clients at state hospital facilities.

The attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority has a projected maximum amount payable of Four Hundred Eighty-Five Thousand Six Hundred Four Dollars ($485,640.00) for the period of October 1, 2023 through June 30, 2025. The actual cost associated with the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority is dependent on the number of state hospital beds utilized by DHHS - Behavioral Health during the term thereof. Currently, DHHS - Behavioral Health has placed one (1) Humboldt County client at a state hospital in fiscal year 2023-2024.
Expenditure appropriations related to the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority have been included in the approved fiscal year 2023-2024 budget for DHHS - Behavioral Health Administration budget unit 1170-424. Funding for the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority is available through state realignment revenues received by DHHS - Behavioral Health.
STAFFING IMPACT:
Approval of the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities. However, this alternative is not recommended since it would prevent DHHS - Behavioral Health from placing Humboldt County clients who require twenty-four (24) hour supervision at state hospital facilities when no other facilities are available.
