RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Adopt the attached resolution which authorizes the Humboldt County Department of Public Works to submit a Notification of Intent to Comply with the requirements of California Senate Bill 1383 to the California Department of Resources Recycling and Recovery in accordance with California Senate Bill 619; and

2.                     Direct the Clerk of the Board to return a fully executed certified copy of the attached resolution to the Humboldt County Department of Public Works for submission to the California Department of Resources Recycling and Recovery.

DISCUSSION:

The past five (5) years have been some of the top ten (10) warmest years on record in recorded human history.  This urgency in climate change has led the State of California to adopt California Senate Bill 1383 (“SB-1383”), a bill aimed at reducing methane-producing organic waste in landfills.  SB-1383 went into effect this year and jurisdictions that do not meet the requirements of this state law are subject to fines of $10,000 per day.  Although, the County of Humboldt is continuing to make progress towards full compliance with SB-1383, there are aspects of the county’s programs which have not yet fully matured.

 

California Senate Bill 619 (SB-619”) was passed in 2021 allowing for one (1) year’s relief from administrative penalties for jurisdictions that were affected by the COVID-19 pandemic.  A condition of this relief is that jurisdictions must submit a Notification of Intent to Comply to the California Department of Resources Recycling and Recovery (“CalRecycle”) for approval by March 1, 2022.  In addition to a Notification of Intent to Comply, counties must also provide a schedule for compliance and a formally adopted resolution supporting this process. 

 

It is the intent of the Humboldt County Department of Public Works (“Public Works”) to develop SB-1383 programs during 2022 with implementation by Jan. 1, 2023.  The SB-1383 Road Map is being prepared in cooperation with the incorporated cities in Humboldt County and the Humboldt County Waste Management Authority to offer regional compatibility and guidance with discussions throughout February and March 2022.  The county needs to file the Initial Jurisdiction Compliance Report, along with a copy of the proposed SB-1383 Enforcement Ordinance, by April 1, 2022. 

 

FINANCIAL IMPACT:

There are no direct costs associated with authorizing Public Works to submit a Notification of Intent to Comply with the requirements of SB-1383 to CalRecycle in accordance with SB-619.  Significant, but currently unknown, future costs associated with the implementation of SB-1383 will be brought forward as programs are developed.  As a result, adoption of the attached resolution will not impact the Humboldt County General Fund.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by building interjurisdictional and regional cooperation and creating opportunities for improved safety and health.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to adopt the attached resolution authorizing Public Works to submit a Notification of Intent to Comply with the requirements of SB-1383 to CalRecycle in accordance with SB-619.  However, this alternative is not recommended since it could subject the County of Humboldt to ongoing administrative penalties of $10,000 per day.
