SUBJECT:title

First Amendment to the Lease Agreement with the Humboldt County Fair Association Regarding the Operation, Management and Maintenance of the Humboldt County Fair and Fairgrounds (4/5 Vote Required)end

 

RECOMMENDATION(S):Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached first amendment to the lease agreement with the Humboldt County Fair Association regarding the operation, management and maintenance of the Humboldt County Fair and Fairgrounds (4/5 Vote Required); and

2.                     Direct the Clerk of the Board to return one (1) fully executed original copy of the attached first amendment to the lease agreement with the Humboldt County Fair Association regarding the operation, management and maintenance of the Humboldt County Fair and Fairgrounds to the Real Property Division of the Humboldt County Department of Public Works for further processing.

DISCUSSION:

Since 1926, the Humboldt County Fair Association has been leasing and operating the Humboldt County Fairgrounds under various agreements with the County of Humboldt.  On July 1, 2020, the county and the Humboldt County Fair Association entered into the current lease agreement regarding the operation, management and maintenance of the Humboldt County Fair and Fairgrounds.  The current lease agreement with the Humboldt County Fair Association is scheduled to expire on June 30, 2025. The Humboldt County Fair Association and the county have mutually agreed to a one-year extension of the lease term.

 

The attached first amendment to the lease agreement with the Humboldt County Fair Association will extend the term thereof through June 30, 2026, with all other terms and conditions of the lease remaining unchanged during the extension period.  The extension of the lease term will provide additional time for the Humboldt County Fair Association and the County of Humboldt to engage in discussions regarding potential revisions or updates to the terms of the lease agreement moving forward. Pursuant to Government Code Section 25536, the Board of Supervisors, by a 4/5 vote, may enter into a lease of property owned by the County of Humboldt without competitive bidding.

 

Accordingly, staff recommends that the Board approve, and authorize the Chair of the Board to execute, the attached first amendment to the lease agreement with the Humboldt County Fair Association regarding the operation, management and maintenance of the Humboldt County Fair and Fairgrounds.

 

SOURCE OF FUNDING: 

None

 

FINANCIAL IMPACT:

There are no direct costs associated with the attached first amendment to the lease agreement with the Humboldt County Fair Association.  As a result, approval of the attached first amendment to the lease agreement with the Humboldt County Fair Association will not impact the Humboldt General Fund.

 

STAFFING IMPACT:

Approval of the attached first amendment to the lease agreement with the Humboldt County Fair Association will not impact current staffing levels.

 

OTHER AGENCY INVOLVEMENT:

California Department of Food and Agriculture

 

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to approve the attached first amendment to the lease agreement with the Humboldt County Fair Association regarding the operation, management and maintenance of the Humboldt County Fair and Fairgrounds.  However, this alternative is not recommended as it will limit the Humboldt County Fair Association’s ability to operate, manage and maintain the Humboldt County Fair and Fairgrounds.
