RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached first amendment to the professional services agreement with Kevin Kelly regarding the provision of psychological evaluation services for the period of December 1, 2020 through December 31, 2022;

2.                     Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the professional services agreement with Kevin Kelly dated October 9, 2020, after review and approval by County Counsel, Risk Management and the County Administrative Office; and

3.                     Direct the Clerk of the Board to return one (1) fully executed original copy of the attached first amendment to the professional services agreement with Kevin Kelly to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:

On October 9, 2020, the County of Humboldt entered into a professional services agreement with Kevin Kelly regarding the performance of court-ordered competency and psychological evaluations of juveniles pursuant to Sections 635.1 and 709 of the California Welfare and Institutions Code for the period of December 1, 2020 through December 31, 2022.  The attached first amendment to the professional services agreement with Kevin Kelly will expand the scope of services provided, and increase the maximum amount payable, thereunder in order to allow for the performance of court-ordered psychological evaluations of adults for the period of August 31, 2021 through December 31, 2022.  

 

Accordingly, the Humboldt County Department of Health and Human Services - Behavioral Health (“DHHS - Behavioral Health”) recommends that Board approve, and authorize the Chair of the Board to execute, the attached first amendment to the professional services agreement with Kevin Kelly regarding the provision of psychological evaluation services for the period of December 1, 2020 through December 31, 2022.  It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the professional services agreement with Kevin Kelly dated October 9, 2020, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed psychological evaluation services.  

 

FINANCIAL IMPACT:

The attached first amendment to the professional services agreement with Kevin Kelly will increase the maximum amount payable thereunder from $50,000.00 to $65,000.00 for the period of December 1, 2020 through December 31, 2022.  However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the professional services agreement with Kevin Kelly in its entirety.

 

Expenditure appropriations related to the attached first amendment to the professional services agreement with Kevin Kelly have been included in the approved fiscal year 2021-22 budget for DHHS - Behavioral Health Children and Family Services budget unit 1170-497.  Funding for the attached first amendment to the professional services agreement with Kevin Kelly is available through state realignment revenues received by DHHS - Behavioral Health.  As a result, approval of which will not impact the Humboldt County General Fund.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, creating opportunities for improved safety and health and providing community-appropriate levels of services.

None                                          

 

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to approve the attached first amendment to the professional services agreement with Kevin Kelly regarding the provision of psychological evaluation services.  However, this alternative is not recommended since it will severely limit DHHS - Behavioral Health’s ability to provide appropriate levels of services to its clients.
